Hello,

A friend of mine wants to know if he can apply for naturilization 3 months or 6 months prior to the full 5 years of becoming a permanent resident. In other words, he should be 5 years of PR in June of 2007. Can he apply now or do he have to wait till march (that is 3 months before). Any help will be highly appreiciated...

USCIS PROCESS

06-13-06 > Sent I-130 to Californian Service Center.

07-12-06 > NOA 1 Received

07-17-06 > I-130 Checks cashed.

09-26-06 > USCIS touched case.

09-27-06 Case Approved. No RFE or hicupps. Koool

NVC PROCESS

10-04-06 > Case number Assigned.

10-16-06 > DS2032 and AOS fee generated

10-17-06 > Paid AOS fee using Jame's shortcut

10-17--06> Wife E-mailed Choice of Agent DS2032

10-24-06 > Choice of agent accepted.

10-30-06 > IV fee bill generated.

11-08-06 > Sent I864 E-Z using James shortcut.

11-16-06 > Received and sent IV fee bill next day delivery.

11-21-06 > IV fee entered into NVC system

11-22-06 > NVC system tells me some documents mssing or incomplete,. Turns out to be DS230

11-24-06 > Sent DS 230 form with evidence using James shortcut.

11-27-06 > DS230 entered into NVC system.

12-14-06 > RFE on marriage certificate. NVC states it is not the original.

12-15-06 > Sent and e-mail and called to argue that the document is indeed the original. Lady said she will have a supervisor look at it.

12-26-06 > Called again to see if a supervisor looked at it. 12-27-06 > Delivered at the NVC at 11:47AM. Still waiting to hear the completion of my case...

01-16--07 > CASE COMPLETED

03-20-07> Interview in Dakar, CO was not satisfied with Employer letter. Reschedule for 03-27

03-27-07> CR1 Visa Approved was told to pick up on in 2 days

04-14-07> Entered the US, JFK, no hassles.

He can apply 90 days prior to his 5 years anniversary. There is a difference between 3 months and 90 days. Make sure he counts the days and it is 90 days, NOT 3 MONTHS. Even if the application is few days early, it can be rejected. Also it is good to be on the safe side and wait few more days (send the application 85-87 days before the 5 year anniversary).

My Parent's Timeline

2011-03-14: Mailed application to USCIS

2011-03-16: Application was recieved NOA1 to follow in the mail.

2011-03-21: Received text stating application recieved 03/16/2011.

2011-03-28: Received NOA1 for both petition in the mail.

2011-06-20: Received NOA2 for both petition in the mail. (APPROVED!!)

--- NVC ---

2011-07-21: Haven't heard anything from NVC. Called them and was informed that the Approved Petition was received 2011-06-18. What's taking them so long?!?!?!

2011-07-22: Back on track! Called the 24 hr hotline and got the NVC Number (^__^)

2011-07-23: My parents e-mailed NVC and filed DS-3032 electronically.

2011-07-25: I received an e-mail stating that I am the Choice of Agent for my Parents.

2011-07-25: Called NVC and I got their Invoice Identification Number!!!

2011-07-26: Made online payment for AOS Bill.

2011-07-27: Made online payment for IV Bill.

2011-07-29: AOS payment posted PAID

2011-09-27: Sent AOS, DS-230 & supporting documents to NVC.

2011-10-19: CASE COMPLETE

2011-11-17: Medical Complete

2011-12-08: INTERVIEW!!! - MOM got approved. DAD on AP!!!

2011-12-16: DAD was issued a visa
