Hello there and thank you for taking the time to read my post. What im looking for is an answer from someone with this same or close to same situation or related experience. I have filed petition for my wife to come to the US. I am a US citizen and i have a felony from 5 years ago for forgery. Petition has been approved Dec 23 and forwarded to nvc. NVC put us in the system 2 weeks ago and i have now paid the aos fee and sent in financial documents and 2013 tax return that shows i made 33000 last year and letter of employment that says i make an annual average of 55000 which i would have made last year but 3 trips to phil including our wedding set me back..2012 i didnt work at all 2011 i made 9000.. i included letter stating i had transitioned back to indiana in 2012 and took care of my sick step mother while looking for employment. Also included letter of requested transcript for 2012 in which irs stated to let this letter serve as proof no tax return was filed for 2012. In section INA 212(a)(4) for consular and visa issuing officer guidelines in relation to the applicant becoming a public charge it says they may consider..employment history or any other factors.. i have been with the same company exactly 1 year and have an excellent future with this company.. question is will we forsee any problems with these factors.. thank you for your time

Well USCIS does the background checks on petitioners and you were approved.

Looks like you need a co-sponsor and that is iffy for Philippines they don't really like co-sponsors. You need 2013 taxes done , 2012, 2011. You said you didn't meet guidelines for 2013 but now looks good. You need a co-sponsor that is your biggest hurdle.

And also long as your fiancee' knows of your past and when asked knows and can answer (not a secret) you will be fine on that.

Dwheels thanks for quick response.. truck driver here and bored driving.. actually 2013 taxes are filed and sent with all schedules inluding 1099 that states i made 33000 last year..infact jointly filed because she is my wife as aug 24 2013.. applied for itin for my filipino wife through irs and was quickly accepted. Yes shes awsre of and accepting of my felony.. but will the visa issuing officer be ?

It's really now all on her. I doubt they will bring it up. Because unless you were a drug trafficker or sex crimes with children your background check would not have been good.

Just advise your wife that if she is asked about your pass to be honest and just don't be rattled or nervous (I know easier said than done).

Since you meet the guidelines for support I see no issues.
