Hello everyone,

New guy here. I found this forum to be very informative, so I hope someone has the answer for my question/situation. I could not find what I'm looking for through the search button.

Here's my situation: I want to file a K-1 petition for my fiance, but before I met my fiance her sister has already filed a petition for her through the relative petition.

Will my petition (K-1) and the sister petition for the same beneficiary complicate the process and slow down both applications? How do I notify USCIS that the beneficiary has another sponsor who has filed a separate petition? Will this red flag both petitions?

The sister petition has been received and processed by USCIS, but I think her case is still sitting in the consulate station and so far she hasn't receive any interview date. My fiance advises me that I should include a letter with my petition to inform USCIS that her case is pending under another petitioner.

Not an issue, nothing you need to do.

If her case is at the consulate, she will be receive a interview date soon.

But if her sister just send the patition and receive approvation by uscis the case is diferent.

Remember that a petition for sister is long, that can take 10 or 12 years.

Ask to your fiance when her sister sent the petition.

Her sistercan cancel her patition, and you can start your patition.
