So my Fiance resides at the same house as mother who will be the co-sponsor (just incase). However, he was not declared in his mom's tax and has his own income, therefore he's independent. Should we include him in the household size count?

His mom will be a co-sponsor? Then no he will not be included with his mom's documents, just his mom, you and others she claims as dependents on her tax return if any.

Your going to live with your future husband and his mother...and he is independent? I see a red flag here.

I would say household size is how many live there , that's usually what that means but I have my own place so our new total is 3.

So a co-sponsor is ultimately the one at risk in bringing someone over? Wish I had one...

Your fiancé is the main sponsor. Assuming he has no dependents, his household size will be 2 (your fiancé and you). It does not matter if he lives with his mom or not, she is not included in his household size.

If your mom is a co-sponsor, then her household size is her, plus you, plus any dependents or spouse (if married). If your fiancé's mom is not married and has no dependents, then her household size would be 2 (fiancé's mom and you).

Interesting...so the co-sponsor (mom) gets to take the tax dependent deduction of the sons fiance. When they marry does this change?

Just checking, is your fiance going to send you an I-864 for your K-1 visa interview? Or are you asking in advance for your AOS?

Hope you and your fiance already know that an I-134 is the one required for your visa interview. :)

That isn't what is being said. In regards to the I-864 and listing dependents is what is talked about, not taxes.

When trying to get USEM to accept a co-sponsor with the K-1 (which is difficult to do with USEM), it is recommended to complete both the I-134 (the required form) and the I-864 as many times having the I-864 sways their decision.

That's interesting to know, Hank. good.gif I have this impression that an I-864 is only applicable for family-based visas.

No, the co-sponsor cannot claim the foreign fiancé on taxes.

No, I'm not gonna live with his family. We will trandfa

We will transfer to a 2 bedroom apartment when I get there

Ahh, ok good. Seems a bit complicated. Hopefully your fiance has the funds to take good care of you. Watch out for the CFO, don't give them info that they don't ask for.
