Hello guys;

I am posting here to get answers for my wife.

I myself am now confused by reading some posts about eligibility dates (either for 3 year rule, or 5 year rule).

Based on 5 years rule, when exactly is she eligible to send her package to USCIS ?

We are getting ready now, so on the exact day we will be at the post office for sending out the package smile.png

Provided that since she has been legal resident (08/31/2010 date on the card) she is always living in the same states.

Never travelled out of the USA.

Thank you for your advice.

if you two are still married, she can apply now!.. she's been eligible since 2013

3 year rule = Married to the same US Citizen

5 year rule = divorced or married to a different US citizen.

If applying based on 5 years of residence, her eligibility window starts after June 1st, 2015.

You can check if you meet all the basic requirements by looking at the eligibility worksheet at http://www.uscis.gov/n-400 (third link from the top).

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

if you two are still married, she can apply now!.. she's been eligible since 2013

3 year rule = Married to the same US Citizen

5 year rule = divorced or married to a different US citizen.

In addition 5 year rule for citizenship also applies when your LPR status was obtained through any of the Employment Based Petition (EB1, EB2, or EB3 categories). You can typically apply as early as 90 days prior to the 5 year or 3yr anniversary (based on the eligibility).

But I am on H1B and she is the LPR.

And I am waiting for her to be USC before applying for AOS. That's why I need to know the exact date based on the 5 year rule, so we can prepare ourselves in advance.
