Hello everyone,

Here's a little situation for me. I'm going for a vacation this may with my 10 years green card . Filed tax jointly with my husband and we will pay our tax that we owe like in staggard or monthly arrangement. You think it will be a problem if I come back from vacation? And we live in a different address now. Also my question what documents should I gather now in order for me to apply for a 5 years marriage for citizenship. thank you.

Make a copy of the front and back of your GC and put it in a safe place. Filing for citizenship based on being a LPR for 5 years only requires you to show your LPR since date and to show all trips outside the US. Here is the Guide to Naturalization for you to look over. Page 18 is where the flow chart starts for your eligibility. All you need for your vacation is your passport, any required visas for your destination based on your home country's passport, and the GC. Just make certain the name on the ticket matches the name on the passport and if the GC has a different name, you may want to bring a long a copy of your marriage certificate to help the airline employees make the connection that you are the same person. Immigration does not enforce tax law. So the USCIS will not care about your tax situation--that is between you and the IRS. USCIS only cares that you FILED your tax returns when you apply for naturalization.

You might want to complete the AR-11 on-line to change your address and your husband should complete the I-865 to inform the USCIS of his address changes per the I-864 instructions. That way you begin to complete the physical residency requirements associated with naturalization. As long as your vacation is less than 6 months it will have no impact on your naturalization.

thank you so much for the insight Dave. No I can have a peace of mind:) I think I will do the change of address after my vacation since I might be moving again lol. I think if you have the lease with you for 5 years that would be a good proof that your living in this country for 5 years now?

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online
