My fiance was born in New Zealand but is currently a citizen of Australia. His birth certificate lists his middle name, but his citizenship papers and passport do not. All the paperwork we've done had his middle name because they ask for it, and only when he went to his interview was he told it was a problem! Now our petition is up in 20 days and they are saying he needs a new passport that has his middle name on it, but to do that he needs to get a legal name change. All of this will take almost 20 business days to complete, which will extend past the validity of the petition. What do we do? Is there any way to contest this, or any way to extend the petition, or any way to talk sense into the consulate? Help!

Approved visa petition expiration at the interviewing embassy/consulate seems to be the recent recurring topic, likely due to recent protracted processing time at NVC.

As far as I know for Australia you can email them a PDF of the petitioner asking for an extension(has to be petitioner) and I think on that they need to re-affirm and sign that they will marry the beneficiary within 3 months of entry. But send them an email to ask and and confirm that, you should get an answer within 2 business day if you are lucky.

Good luck. I was a bit worried about not having a middle name at all, but it was all OK.
