I have tried to get my daughter's birth certificate for months now. They keep saying come back next month, in three weeks, next week etc. Is there anything I can do as far as taking them to court? I'm sure it is illegal for them to do this. I can't do my daughter's CRBA if I don't have her NSO birth certificate. Please help

Birth certificates take forever, sometimes up to 6 months. It's not that they're witholding it, chances are, they haven't even processed it.

Try going to the city hall the live birth was submitted. Go to birth reports (or something like that). Ask for an endorsement letter - document contains the date when they sent it to NSO. Bring the endorsement letter to NSO main and ask for the birth cert to be expedited.

No, they are doing it on purpose. We have been through those steps two or three times now. We had an endorsement letter but they still couldn't "find it" or something like that. It was ridiculous.

I had the same experience. Said they were unable to find my son's birth certificate and just come back in 2 weeks. On the 2nd attempt, I brought my baby with me. Everybody seemed to be concerned, helpful and even offered us a seat inside their office. I showed them our appointment at the US embassy for my son's CRBA and the lady from window 15 gave me an endorsement and instructed me to go to their office at Quezon Ave, just beside Merced bakeshop. I was able to get my son 's birth certificate after a week. Just a day before our appointment at the US embassy.

My friend got her kid's BC in just 18 days doing the steps I posted. I'm not surprised that it works for some but not for others.

Only problem is that I'm not in the city she was born in, that is why my wife's cousin is trying to get it. So I can't go to the city hall etc. I'm in Manila, she was born in Iloilo. Before I moved to Manila they said we could pick it up at the NSO in Manila.

Mine sat in the provincal capitol for over 2 1/2 months. I also emailed the person in the other post and they replied months later, very strange but they did respond. SNAFU...it's the Philippines. Did you ever get a negative receipt of birth?

Yes I got two negative receipts of birth. From the NSO in Iloilo and the NSO in manila. They said today that it was sent to the NSO in Quezon City and that is the only place I can get it. Hmm we will see

I went to my local NSO office and they looked up by municipality the records of birth and then I got copies of all the forms that were shipped to Manila (QC) and then I asked for the BC. Iloilo may have not sent them yet but if your not there to check....maybe Yolanda slowed things down? If they have the transmittal docs and the receival then they can go look for the box that it should be in. It caused me a significant delay also because I could not process my childs CRBA until I had the BC and then I wanted to wait to do the I-130 after I got the CRBA which I should have done a DCF. Oh what fun it is but I am done and we are all snuggled in our USA home, day 5 now.

If I had to do this all over and knew the hassles I think I would have not done it.

Eep. So complicated. I guess I'm lucky I'm giving birth in QC and NSO main is just a 5 min jeepney/tricycle ride away. City Hall is walking distance. I wish I wish I wish it won't be as complicated for me. I'll be processing all of that plus the CRBA, passport and CR1 stuff myself after giving birth and my husband isn't here.

YOur wives are lucky you guys are present to help them out through all this.

Eep. So complicated. I guess I'm lucky I'm giving birth in QC and NSO main is just a 5 min jeepney/tricycle ride away. City Hall is walking distance. I wish I wish I wish it won't be as complicated for me. I'll be processing all of that plus the CRBA, passport and CR1 stuff myself after giving birth and my husband isn't here.

Senna, your a brave lady for sure. My wife would not have been able to deal with this. It just seems that anything that could go wrong does. Even the CRBA when I submitted it they got my email address wrong and when I was inquiring cause the deadline was near I found out they had done a RFE...2+ month delay on that too. Wife is having a hard time adjusting but I oredered items from a website that sells dried fish and filipino soy sauce and vinegar. Gourmet Tuyo? She did order some kind of Tuyo...will have to cook it in the snow as not allowed insidedead.gif

An RFE for the CRBA??? D:

LOL it's not that I'm brave... it's just that nobody else would do it. My husband has the patience of an aggravated bull and the attention span of a goldfish lol.

The good thing about gourmet tuyo is that you don't have to cook it so your house and your neighbor's house won't smell funky.
