hi guys..just wanna get some ideas and opinions from the other members.. my fiance's annual income is more than 12k$ ..and im kinda nervous if the CO will approve me a visa..for what i know he didnt meet the 100% or the 125%.. need your feedbacks guys plss.. thank you :)

Suggest you search the recent posts regarding the I-134 and level of income. The letter of the law regarding I-134 income requirements is 100% of the poverty guideline. That means for a family of two (2) it's: $15,510.00 USD per year. But, keep in mind that the adjudicator is fully aware that later in the process you will need to file the I-864, which requires 125% of the poverty guideline, which for a family of two (2) is currently: $19,387.00 USD per year. Note that its even higher if you live in Alaska or Hawaii.

Sorry to say that if your fiance's income is only 12K per year that you will not be able to qualify for fiance visa. However, there is an option to include a co-sponsor (aka joint sponsor) to accompany the I-134. Anyone who is considering filing a K1 and their income falls below, or between 100% and 125% of the current poverty guideline should consider getting a co-sponsor.

yeah thats what i know of too,but the thing is which form shouldwe use? the I-134 or the I-864? and we have his uncle as a co-sponsor..and the thing is they said in manila us embassy they dont accept co-sponsors..

I assume that you have not had the interview for K1 visa? If that's the case then you need to complete the I-134 first. After you marry you will need to adjust status (AOS) in which the fiancial requirements a little harder to meet.

i am about to schedule an appointment for the interview but me and my fiance are still waiting for the 1040 and his uncle's w2 and 1040 to arrive.. just confuse coz here some members said i need to have an I-864 together with the I-134 form..just worries that the embassy in manila wont accept our co-sponsorship.. btw thank you for replying :)

That's incorrect. You do NOT need the I-864 now. Only the 1-134. http://www.visajourney.com/content/k1guide

You need a co-sponsor for sure unless your fiance can find a new job/2 jobs to hit the requirement. It is known for USEM not to accept co-sponsor but you can try since I have seen people getting approved with Co-sponsor.

( ) August 2014: Received EAD (I forgot what date I got them but I did receive them less than 5 days from the 12th)
10th September 2014: Interview Waiver received (I wished I was interviewed)
April 23, 2015, we registered your permanent resident status and mailed you a Welcome Notice

I am very curious about your statement of the USEM. I assume that is the US consulate in Manila? I've been away from the immigration world for a few years so am not sure what's been going on. I've seen several posts on this site that some consulates are behaving in a unilateral fashion. For example, your comment about Manila rejecting co-sponsors. Now, of course it's known that this flies right in the face of the US State Department, which fully accepts and supports co-sponsors. Perhaps there are members on this site who have been rejected at the consulate level in Manila or other cities of the world who can corroborate that. It seems to me that there are legal grounds to get these rulings reversed. Especially if the consulate was so bold to reject the co-sponsor when they can prove they are fully able to meet the legal income requirements.

This is from the Manila Embassy Instruction Letter:

k. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form with original signature will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

K-1 Visa

Oct 1st, 2013 – Mailed in I-129F Package to Dallas Lockbox.

Oct 4th, 2013 – Package Delivered.

Oct 9th, 2013 - NOA1 Text and Email

Oct 15th, 2013 - NOA1 Hardcopy received in mail. Notice date on hardcopy says October 8th.

Nov 13th, 2013 - NOA2 - update on USCIS website

Dec 9th, 2013 - Petition received at NVC

Dec 11th, 2013 - Petition sent to Manila

Dec 19th, 2013 - Embassy receives petition

Dec 29th-Jan 8th-Our first New Year's together.

Feb 23rd- Fly to Manila to be with Ema for the interview.

Feb 27th, 2014 - Interview scheduled. We were APPROVED dancin5hr.gif

Feb 28th, 2014 - Ema does CFO- Passes with flying colors.

Mar 6th, 2014 - Visa in hand and ready to fly home.

Mar 14th, 2014 - POE Los Angeles

Apr 17th, 2014 - Our Wedding date. (L)

Sept 5th, 2014 - Mail package to Chicago

Sept 9th - Package Delivered

Sept 11th - NOA1 Texts and Emails.

Sept 17th - NOA1 Hardcopys received.

Sept 20th - Biometrics appointment letter received. Appointment for Oct 2nd.

Oct 2nd - Biometrics Done!

Nov 15th - EAD & AP approved and on the way!

No interview or interview wavier notice received

Jun 30th, 2015- Received welcome notice and approval.

July 23rd - Ema finally has her Green Card :dancing:
