You usually need to be resident in the DCF-available country for a minimum amount of time as a legal resident before you can file with that local consulate.

USCIS confirms this, but does not state how long you need to be resident for - but if you're just visiting as a tourist, you're unlikely to be a resident anyway.

Form I-130
U.S. citizens that legally reside in Guatemala may file Form I-130 (Petition for Alien Relative) at the Guatemala City office by mail or in person during normal business hours.

How long are you intending to be in Guatemala and are you intending to take up residency there until your partner can immigrate back into the USA?

A previous VJ member has written up their experience of DCF in Guatemala that may help you: http://www.visajourney.com/forums/topic/432344-dcf-process-in-guatemala/

If you don't qualify for DCF, you will file your I-130 the normal way, as outlined in this guide: http://www.visajourney.com/content/i130guide1

What do you mean file from down there? You mean file at the embassy. Or just sending it back to the US (It would be the Chicago Lockbox of sending from outside of US).

Read the guides about the I-130 http://www.visajourney.com/content/i130guide1
