Hello All,

We are preparing our AOS documents and would like to find out from you if the I-864 (Affidavit of Support) needs to be notarized like the I-134 which my fiance filled out for my embassy interview. Also, there seems to be many versions of the I-864. Should we be filling out the I-864EZ version instead?

Hoping to hear from you.

Best regards,

Audrey

Audrey,

I-864 does not need to be notarized.

You do not provide any information that would enable someone to answer your question about I-864EZ. Read the form instructions to determine if that form is appropriate for you.

I-864EZ is used in cases where income is more than 125% poverty line for past 1-3 years, simple cases like that.

Example my income is $45,000 so I-864EZ is the form that I will use.

Also use IRS Transcripts with these forms, they are free.

Are the Affidavit of Support forms required to be notarized?

No. The sponsor just has to sign the form. You should know however, when the sponsor signs an Affidavit of Support form, he/she certifies that the nformation provided, transcript and/or photocopy of tax documentation is true and correct, under penalty of perjury.

See: http://travel.state.gov/pdf/I-864GenInfo-FAQ-Final.pdf for more details.
