Hey guys,

I finally found a co-sponsor, knowing exactly if the Consulate we use will allow a Co-Sponsor, I'm not sure but I had some questions.

1. Does the co-sponsor have to have a copy of his birth certificate?

2. I read on other forums that there is a section (I think section 9) on the i-134 form that the Co-Sponsor fills out that he has to put down who wil be his dependents, obviously my fiancee will be but I read that I as well have to become his dependent and he has to meet the income requiremets of dependents that includes Him, me, and my fiancee. Is this true? and can someone explain to me exactly how this works. Will he be claiming us on his taxes?

3. Since I don't have any recent taxes (besides 2013-started working in October) do I have to write a statement as to WHY I don't have any recent taxes? I've been in college and was unemployed in 2012 to half of 2013.

4. My uncle whom will be the co-sponsor made more income in 2013 than in 2012. Which tax return will he have to have a copy of, his RECENT as in 2012 or 2013? (since it is 2014). haha. I just want to be absolutely correct before I give him anymore information.

5. Any evidence of income will help with the requirements, right? So he can get a copy of his 1099 as part of his military benefit income?

I think for now that is all my questions, I'll do another post if I have anymore. I hope you guys can help. :)

Yes or he can provide all pages of passport (This is to proof that he/she is USC/LPR)

Most recent ITR, pay stub, employment letter, W2 (whichever is applicable). You only need to submit the most recent but for I-864 during AOS, you need to submit 3 years.

2. Foreign fiance(e) is listed in #3. If they do not claim you on their taxes, then you(the USC) are not listed as a dependent of the co-sponsor. An affidavit of support is not linked to and from the IRS. You do not start claiming someone on your taxes that you sign an affidavit of support for just because you agreed to sponsor them.

I've been in college and was unemployed in 2012 to half of 2013. <- If you already filed for 2013, then you take a complete copy of your 2013 tax return, as you only need most recent. If you have not filed yet, then you provide a statement as to why you did not file in 2012 and bring a copy of your 2013 W-2 too.

I just want to be absolutely correct before I give him anymore information. <- Same answer as the one above this. Just needs most recent, whether it be 2012 or 2013. He should also provide proof of current income with a letter from employer and most recent pay stubs,

5. Any evidence of income will help with the requirements, right? So he can get a copy of his 1099 as part of his military benefit income? < - He should total up all his income and list that on the I-134. He should provide proof of all income.

I think for now that is all my questions, I'll do another post if I have anymore. I hope you guys can help. smile.png

You only need to submit the most recent but for I-864 during AOS, you need to submit 3 years.

Co/joint sponsors only need to provide a copy of the bio page from their US passport(if using that as proof of being a USC), not all the pages. Also, that would not prove they are an LPR, as an LPR does not have a US passport. An LPR provides a front and back copy of their green card.

For the I-864, you are only required to submit the most recent tax transcript. You must list the total income from the last years of returns on the form itself though.

@Janice&Micah: Just out of curiosity, where are you getting this information from? There are loads of different pieces of advice claiming this or that, however some situations may only apply for certain countries. I just want to make sure that information isn't based on assumptions, that's all smile.png

@Bristin92: So i'm not sure if this is applicable to you but is your uncle self-employed? I'm only asking this because in the current instructions form of the I-134 it states that if self-employed a tax return is needed. My fiancee and I had the same question because we also have a co-sponsor. To ensure that the interview has what they need I called the Amsterdam consulate to ask their advice on this. The lady told me that they won't deviate from the instructions, so no tax return is needed unless the sponsor is self employed. I just wanted to make sure that this piece of information is coming directly from the consulate which follows USCIS regulations for the I-134.

Is the bio-page of the US passport a requirement? I haven't seen it listed anywhere so I would just want to make sure that we won't be overcompensating information!

I just do a lot of reading and summarized what i read from every consulate. Most of the consulate wants them. I am not answering for consulate specific. It's just a guide where everyone tries to follow. You can ignore my advice if it does not apply to you. I learned from the more experience VJ member and come to help others if I know the answer to it.

The instructions for the I-134 are vague. A lot of consulates use the I-864 guidelines, even when using the I-134 for a K-1. There are no guidelines for a co-sponsor with the I-134. Proof of citizenship or permanent residency is something outlined in the I-864 instructions for a joint sponsor. I advise those using a co-sponsor for the I-134 to bring that proof just in case it is asked for. It is better to have something and not need it, than to not have something and need it.

I appreciate the advice! The I-134 instruction are definitely vague and we were worried about the expiration date on the form as well, but thankfully older versions are accepted still.

I will bring a copy of the bio-page just to make sure I have it in case they ask for it. The income tax returns are not needed in our case, the lady on the phone basically said they would not even look at them haha. So I guess we can confirm that ITRs are not essential (for the Dutch consulate at least) unless the main or co-sponsor is self-employed. :)

Some consulates do go by the I-134 instructions and won't need tax returns, just proof of your income. I believe Australia is like that as well, and I think London too. I still just advise the same to everyone: most recent tax transcript, letter from employer and/or most recent pay stubs. If someone asks their consulate directly and knows they won't need a certain document, then they can skip it if they wish. However, tax transcripts are free and easy to get. Plus the information from the last 3 years of taxes(and the most recent one will need to be submitted) when filing for AOS in the not too distant future,
