Hello,

I have a couple questions regarding the I-864 form I was hoping you all could help me with. See, I'm currently here in Peru with my (Peruvian) wife and we were recently approved for her I-130 application. So it appears our next step is to fill out the I-864 form. However, neither of us are employed so my mother, father and a friend of ours (who lives with my parents) is going to be providing the income necessary.

But I'm a little confused about filling out this form. I'm fairly certain that I would check 1.A I'm the Petitioner. I filed or am filing for the immigration of my relative. And then for wherever it says income I would write Zero as I haven't held down any job. And then in part 6, numbers 6-9, I would fill out that information regarding my parents and friend, correct? And then would I check 11 and have them fill out I-864A's? Or would they be Joint Sponsors and fill out I-864's?

You are the petitioner and the sponsor even though you live in Peru as a US citizen I hope you still been filing your US taxes. You have had to have filed the last 3 or show reason why you weren;t required to.

Do all three really need to file? If its just you and your wife you need to be above $19334. Each of you files a I-864.

Thank you, I read both the posts and unfortunately neither fully answered my questions. I have not been filing my taxes, nor have I ever as I've been living with my parents up until I came here to Peru on vacation.

We plan on moving in with my parents upon arriving in the U.S. And we will bringing our son with us as well. So I really don't know exactly, only that I obviously cannot reach $19334 on our own and thus we need the assistance from my parents. So I'm unsure if they need to file the I-864's or I-864A's.

Well you still will fill out a I-864 but you needto go to the IRS.gov site to check about your requirements to file. Which ever parent makes what you need (family of 3 is $24412) so parents sponsoring its their household pkus your wife (I assume your son is a USC) so he doesn't count.

So whoever income you are going to use mom or dad they fill out th eI-864 also and the other parent fills out the I-864a. If your parents file jointly.

Search on VJ for USC filing taxes from abroad there's alot of good info on that.
