Hello all,

I am a US citizen and am engaged to an Egyptian. I have been teaching in Egypt for the last 3 years and that is how we met. We've been dating for almost 2 years and have been engaged since June 2013. He is a university graduate and is 100% fluent in English. He was granted a B1/B2 visa in November and traveled with me to the US in December into January. His current visa is valid for 5 years. We are hoping to get married in the spring and then hopefully live in the US for good after we get married. I am a bit confused as to what visa option is best for him. Is it best to apply for a fiance visa and get married when we arrive in the US and then try to change the status of it? or is it better to get married here and then apply for the spousal immigration visa? Also, getting married on the B1/B2 visa is not even an option, right? Also, when we apply for another visa, does it cancel his current B1/B2 visa? We would like the quickest option, obviously, since we don't really want to be apart while it's being processed. Also, can we apply for these visa's if I am living abroad? Would my mom be able to fill out the Affidavit of Support?

Any advice would be greatly appreciated!

I think they're equally good in this case. Now, some people would say that spousal visa is faster than fiance visa, it is definitely cheaper since you would not have to pay for Adjustment of status, but I believe the USCIS is processing Fiance visas a lot faster right now. You can check the processing times here in Visajourney or in the USCIS' site to get an idea of how long each one takes.

Also, getting married on the B1/B2 visa is not even an option, right? He can marry you on a B1/B2 visa but he cannot stay in the USA longer than what he was allowed by the immigration officer.

when we apply for another visa, does it cancel his current B1/B2 visa? No, he can use his tourist visa, as long as it's valid, until he's issued a different one. He can use it to come to The US while the USCIS is processing the application; although, in the airport, he might be asked to show documents that prove he is returning to his country.

can we apply for these visa's if I am living abroad? Would my mom be able to fill out the Affidavit of Support? Yes, you can. In that case you and your Mom would have to fill one Affidavit of Support each.

Your mom would be able to complete an I-864 as a joint sponsor. You will still need to an I-864.
