I-94 Question for VWP

Hello all,

Thanks for those that have helped me so far on a couple of my other questions.

Hopefully I am not far off now from sending my I-130 & I-485 paperwork, just going through everything with a fine tooth comb.

I have a question about the I-94.

I came to the US on a VWP in October 2013 and my VWP is about to expire on Jan 20 so I am getting all my paperwork sent off by Monday at the latest.

When my boyfriend proposed back in November, I started looking into what we needed to do so I could stay here instead of going back home and I saw that I needed an I-94 number for the forms. I went on to the website to retrieve the number and obtained it which I noted down on my phone. The thing is, I didn't print anything off at the time and now I am wondering if I should have a printed copy of that number from the website? The issue now though is that I have since been back on the website, entered the same details but now it says "Record Not Found".

What does that mean? Would it be normal that a number that I had a month ago is no longer available, even though my VWP has not yet expired? Should I still include the number that I obtained back in November on the forms or would that be invalid now? Is it an issue to not have a printed copy of these records?

Just wondering if anyone had any feedback on this?

I've read varying comments about the I-94 for VWP and wonder if anyone submitted their forms without it?

You will need to show proof of legal entry to file for AoS. That could be a passport stamp or a copy of your I-94W if you entered on the VWP. Sometimes on the VWP your details will be obtainable through the I-94 site, sometimes they won't.

You have tried putting your information into https://i94.cbp.dhs.gov/I94/request.html (and selecting "WT" as the class of admission) and nothing comes up?

Yes I tried on the website using WT as the Admission Code and nothing comes up anymore.

It did back in November which is how I have the number written down but it's not coming up anymore which is strange and I worry that maybe that number is no longer valid.

I guess I will just use the number I retrieved back in November plus passport page with entry stamp and hope for the best!

I wouldn't worry about it, just include a copy of your passport stamp and you should be fine.

I had the same problem that I could no longer see my I-94 so I contacted my local Deferred inspection site which I found on the cbp.gov site there are 70 around the US I contacted my local one & I was told that the system had me down as not in the US any more, so the cbp officer I was talking to rectified/updated the system so that it was showing me still in the US, My I-94 is now again available for me to print off.
