Timeline

Hello everyone,

Looking for advice...

I applied for my removal of conditions I-751 in February 2013, and had biometrics in March 2013.

We then got a RFE in late July 2013 which we gathered all the evidence for and mailed back to them late August/early September 2013.

We are now still waiting and getting very anxious.

I have the letter that permits work and travel until February 25th, 2014 so time is running out and I am worried.

Any advice would be greatly appreciated, thank you!

Jan 10th 2009 - Met whilst I was working in the US on a J1 Visa
July 31st 2009 - I had to leave the US (visa expired and no jobs)
Sep 5th 2009 - I returned to the US to visit for 2 months

Dec 30th 2009 - He came to England to visit me for 10 days
Dec 31st 2009 - Engaged!!! He proposed in London at midnight
Jan 2010 - Sent I-129f application

Feb 12th 2010 - received NOA1

March - I visited for 2 weeks
May 4th 2010 - received NOA2

June - I visited for 2 weeks

16th July - Medical
26th July 2010! - Interview at US Embassy in London
12th August 2010 - Received K1 VISA smile.png
26th AUGUST 2010 - Enter US!!! POE ATLANTA
30th OCTOBER 2010 - Our Wedding - such a perfect day smile.png

Before I go ahead and answer this question I just want to remind everyone reading this thread that there are plenty of the same questions asked with the same responses provided. I am sure with a quick search you should find the answers to your questions. I've found answers within the first 5 pages of this forum.

With that said, to the OP, have you tried calling USCIS? If you take a look at your RFE letter at the very bottom of the first page there should be instructions on contacting the USCIS after a certain amount of time. If you haven't called USCIS yet I would suggest doing it now as you are well outside the processing time. Also make sure you speak with a Tier 2 as they are officers and usually more knowledgeable. If you aren't getting anything from one Tier 2 officer then call again and get someone else.

As for your 1-year extension expiring, you can always make an Infopass appoinment to get it extended.

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Sounds like it's time you take pro-active actions.

First thing first, make an InfoPass appointment to your local USCIS office and ask for an I-551 extension. That way you will be kept in status for another year.

Next, call the USCIS and ask for a service request. If possible speak with a Tier 2 rep and ASK THEM TO SEND YOU A WRITTEN, PAPER COPY OF THE REQUEST.

Then get your local congressman involved. Call them and ask for assistance on your I751, also ask for written paper copy of your request to be mailed out to you.

The last thing? And if it's what your ultimate goal is, apply for citizenship. As long as you are 90 days prior to your "PR Since Date" on your card + 2 years and still married, you are qualified for citizenship.

PR since date ??? if you take your conditional green card… you will see expiration date…. when is going to get expired, if you married with the same person over 3 years ( resident of US)… you can apply for US citizenship … so for ex: your card will expire 01-18-2014, so 3 month before that date you are eligible to apply for citizenship, so in this case it will be 10-18-2013.

This is simple. But I'm not too certain.

You have been a PR since 03/03/2011 right?

if so, your Conditional GC expires 03/03/2013

You are still married to the same US citizen right?

Your NOA for the ROC filing extended your GC for a year up to by 03/03/2014 by which time you would have been a PR for 3 years

My question is? even though you have a pending ROC, Shouldn't you be able to file for naturalization N-400 by 90 days before your 3rd anniversary as a PR which will be 12/03/2013. (90 days before 03/03/2014)

If so, you should have filed N-400 instead of waiting for ROC approval unless you need ROC to file for N-400.

sorry, I don't know about any of this! thanks for the advice though. it was my understanding that you had to be in the country for 5 years before you could become a citizen. Maybe it has changed or maybe I had false information.

I got married to my US citizen hubby in October 2010. So, yes we have been married for over 3 years. But, my original green card expired in March 2013, so we had not been married 3 years at that point.

So, you are saying I can apply for citizenship now? Or because it's after the time I cannot? Sorry, I know I probably sound dumb, but I do feel that correct info is hard to come by...

We went to USCIS for an infopass last week and they stamped my passport which is valid for work and travel for another year, and told us that we will be getting a letter to come for an interview, but they couldn't tell us when...

If you are married to the same person you got the 2 year green card with, then you can apply for citizenship 3 years (minus 90 days) after your first green card issuance. If you are divorced, you have to wait 5 years.

So yes, you are now eligible to apply for citizenship since your original green card was issued in March 2011. :)
