Hello,

I'd like to ask how much actual evidence is needed for IR-1 if you've been married over 2 years. We've been 8 years and been together 10 and have 4 children together. As the evidence mentioned in the guide we don't have joint bank accounts, nor property together (we live with my husband's family). I don't think I have any of our phone or chat records from when we were dating anymore. But do have visa stamps in my old (outdated US passport), residency here in my husband's country and photos.

Is this ok? or I need other things?

The main thing is that do you have evidence of resources to show that you and/or a sponsor will be able to support him along with 4 children together in the US?

Do you make enough and have a reliable income source to qualify to petition for him in the first place?

That would be a more of importance than showing that you guys are together because having 4 children together is good evidence of that.

Henia, I didn't have any of the traditional evidence either. At the time of my husband's visa interview we had been married for 6 years and had one child together. We lived for the majority of those years together in the US. If you have flight itinerary from when you arrived in Algeria, your children's birth certificates listing him as the father, and your residence card in the US that will be more than sufficient in my opinion.

We didn't have conventional evidence either. We have been married for 3 years. We used 3 affidavit letters from our relatives (petitioner's mom, petitioner's friend, and beneficiary's mom) stating that they have knowledge of our bonafide marriage. We also used pictures of us traveling together at different destinations. Records of facebook conversations. Plane tickets, special event tickets like when we went to soccer games (we also added those pictures). Hope some of these things can help you out.
