Hello visa journey,

I'm not sure if my question has been already a topic here but I'm desperate.

Around June I filled my AOS package. Later I got my biometrics appointment and got my fingerprints taken. Then around September I got a letter from USCIS asking for initial evidence. They said my husband didn't meet the 125% poverty line even we stated he did so we needed to submit more prove. My husband's employer wrote another letter and we submitted a copy of his payments, but it wasn't enough because they sent us another letter around a month ago (I got it 3 weeks ago).

My husband works part time which is the reason why he doesn't meet the requirements even though we thought he did. So I know my best chance is to find a join sponsor. I work as a full time nanny but I don't have a work permit. My employers offer to look into it to become the join sponsor I need but of course they are worry about liability.

I've been reading about the sponsor responsibility and what I understand is that mainly reason why i need a sponsor is to secure that I would not be on welfare or ask help to the government like SSI or food stamps. Am I correct?

My potential sponsor is wondering about private parties. Let's say that I have to go to the doctor and I get stuck with a big bill, would they be responsible for that? Should I show them my financials or any debts, loan or any kind of payments I have?

Also my in laws were wondering if there is any kind of insurance that we could buy to protect the sponsor from any liability.

Also, I have to submit my answer before Christmas, can I send a letter asking for more time? I called the national line and they weren't of much help.

Any info you can give me, it would be greatly appreciate, like I said I'm very desperate. I understand that if I don't have what they are asking for or can not get a join sponsor I would have to go back home but I would not like to be deported.

The I-864 sponsors' main obligations to the government is to reimburse them for any means tested benefits that you may receive.

The reason I would never sign an I-864 for a friend is this - the obligation to "provide the intending immigrant any support necessary to maintain him or her at an income that is at least 125% of the Federal Poverty Guidelines for his or her household size." (See page 7 of the I-864). This means the immigrant could sue the sponsors for support if he don't make enough or if he choose not to work. People have been successful in getting courts to order support based on the I-864 even when the immigrants are lazy and don't want to work. So, the I-864 could be an obligation to support the immigrant for the rest of his or her life. And this is why I would never sign the I-864 for a friend or a friend's relative.

Liabilities to 3rd parties has nothing to do with the sponsors.

There is no insurance you can buy to protect the sponsors. The reason is that you can stop working and sue the sponsors for support.

Thank you Aaron. They are considering being my sponsors because I work for them and we have a great relationship. I don't think I would ever think about sue them. And I would thankful all my life for this help.

What about asking for more time so my husband gets another job? He has applied to jobs but hasn't get any yet.

What about asking one of your Husbands family members like his parents for example to be the joint sponsor?
