AOS pending

Hi everyone, I'm just a little bit worried about my husbands file that is pending

we submitted forms i-130, i-485 and i-765. We got a letter which stated that NBC received our i 130 and i765 on october 10 and i485 on october 16. My husband had his biometrics taken on november 7. On november 20 our case status changed to testing and interview and the i130 and i765 are still at initial review.

The reason I am worried is becuase his OPT expired on dec 6th and still his EAD file is in initial review, another thing is that his interview is still being scheduled, but I am scared because I am going to india for a wedding from january 17 to feb 9th and im worried that the interview will end up coming while I am in india. I wanted to know on average how long did it take for you guys to receive your interview notice? and EAD?

1) That's a long wedding.

2) EADs based upon a pending I-485 are usually issued within 90 days.

3) You need to attend the AoS interview with your husband, so if it's scheduled for when you are in India you will either need to re-schedule it (potentially waiting weeks or a couple of months for another appointment) or fly back for it.

When they send you the interview notice, its usually a month or so before the interview date. That means even if he receives the letter while you are not home, I think you will have time to return back before the interview. I don't recommend rescheduling because*sometimes* it takes several months before you will be able to have a new interview. Better be safe than sorry. If the wedding is not so important then drop the idea of leaving. You are almost done and an interview letter will arrive soon.
