Applying for AOS from a Tourist Visa

I entered as VWP and am awaiting AOS approval. I have to leave the country in 3 weeks or so and do not have my AP yet. Hoping to get an emergency AP issued. I would not be leaving if it was not absolutely necessary. We do all have different stories. I posted mine, so far, in the "Introducing Our Members" section.

There seem to be quite a few people who are way outside the AP processing times right now. Many reporting 90 days or more for AP approval rather than the 30-60 stated on the receipts.

Anyone care to share what exactly it is like re-entering on an AP? Do you get taken to another room, is it fairly quick and easy or are you grilled?

AOS TIMELINE

16th December 2005 - Sent I-130, AOS, EAD & AP USPS overnight to Chicago Lockbox

18th December 2005 - Received at Chicago 9.18pm.

23rd December 2005 - NOAs for I-130, AOS, EAD, AP!! Didn't expect them that quickly

13th January 2006 - RFE for Medical and additional I-864 info

17th January 2006 - INFOPASS Apt about RFE.

23rd January 2006 - Appointment notice for Biometrics on 10th Feb.

10th February 2006 - Biometrics Appointment

21st February 2006 - Medical. Cost $250 including all blood tests, Td Shot, TB test and Titers for MMR and Varicella.

27th February 2006 - Appointment with immigration lawyer re. RFE for I-864.

1st March 2006 - Final results Medical. Papers in hand to send.

10th March 2006 - RFE responses to Lees Summit

13th March 2006 - RFE responses signed for at Lees Summit

24th March 2006 - Emergency AP approved in Omaha

28th March 2006- Collected AP

31st March 2006 - EAD Approval online

7th April 2006 - EAD arrived in mailbox.

21st April 2006- Received Interview Date for 22nd June

9th May 2006- Received SSN

22nd June 2006- AOS INTERVIEW APPROVED

REMOVING CONDITIONS

June 20 2008 - Package mailed to CSC under new rules. Would have been an NSC transfer

June 23 2008 - Package recieved at CSC

June 27 2008 - Recieve NOA1

July 16 2008 - Biometrics

July 17 2008 - Touched

September 9 2008 - Card production ordered

*hugs* I'm so sorry to hear about Craig's hand, ktun. You have my best wishes that he'll speedily recover. And boo to all those nasty people that didn't stop for you on the Interstate! >:(

Here's my thought: since you've already got evidence, I'm sure, that you have to go back to court at the order of the CPS. You may not need any additional letters or what have you, if they're already addressed to you and provide information on accommodations, flights, etc. I would take these and make an Infopass appointment asap. Call the Omaha office directly if you have to. Bring these all in, along with your husband (whose hand should be evidence enough!) and basically explain your situation. You should be given an AP on the spot.

It might also help to have letters from your family doctor or the physicians operating on his hand for further proof. If you encounter any trouble, maybe talk to your congressperson and/or senator. They might be able to put a little pressure on but it sounds like they shouldn't need to. Yours looks like a pretty clean case.

15 January 2013 - Sent package off to Phoenix.
28 January 2013 - RFE: signature missing.
06 February 2013 - NOA 1: N-400 received!
27 February 2013 - Biometrics appointment (Detroit, MI).
01 April 2013 - NOA 2: Interview assigned.

15 May 2013 - Naturalization Interview, approved after 15 minutes.

10 June 2013 - Naturalized.

When my hubby came back into JFK on his AP, he was taken back to "secondary". I guess thats always the case when returning on AP, so dont get worried bout it. He was not grilled at all, they just looked over his documents, stamped his passport, AND his I-94 and told him good luck on his upcoming interview. They were very nice.

He even got in the visitors line, and they asked him if he was living here, why in the world did he get in the visitors line? No problems at all to report tho.

DO make sure they take your I-94 (or is yours I-94W?) out when you leave, I guess thats how immigration keeps track and if the DONT take it out upon leaving, it can cause problems, becuz they dont have a record of you leaving, yet you come back in and it confuses the heck out the system or sojme such. Anyhow it equals> Problems. So make sure they take it out on leaving, and you get a NEW one upon returning.

Did I make that clear or am I being my normal confusing self? :lol:

6-15-05 Flew NCY to "fetch" Lake for visit here

8-17-05 He Proposed!

8-24-05 MARRIED!

9- 1-05 - SENT AOS, EAD, AP, & ETC

9-12-05 NOA1 - FOR I-130, I-145, & AP, EAD

10-5-05 RFE for Birth C. & medical

10-24-05 GOT LEARNERS PERMIT

11-3-05 DRIVERS LICENSE :)

11-16-05 overnited RFE

11-17-05 Rcvd NOA2 for EAD, bio set for 12-5-05

11-25-05 Recvd AOS bio letter, apptmt for 12-14-05

12-5-05 Biometrics (they did BOTH!)

Infopass, got temp EAD, AP no luck

12-6-05 Applied for SSN, not in system

12-10-05 AP finally arrives!

12-11-05 1 year EAD card!

12-23-05 Interview letter arrives! 3-3-06

1-17-06 SSN arrives!!

3-3-06 Interview-APPROVED! Passport stamped :)

I tried to get into the Omaha office on Monday and Tuesday this week, but they were closed becuase of the snow. Today (Wednesday) they're closed because they're always closed on Wednesdays so trying again for tomorrow, Thursday, morning. We originally had an INFOPASS appointment for Monday, so the man who was there signed it and said we can go back on Thursday without an appointment, just with that original INFOPASS letter from Monday.

We do have the evidence, reports from the surgery showing the complications and of course all the lovely $15,000 worth of bills to go with it :o I hope they dont give us a problem. They're also used to seeing us, we've been there several times, and particularly used to Craig's hand and arm in various colourful casts and splints. They ask us everytime how it is doing. It's rather amusing going through the metal detectors with pins and fixtures in the hand, they make him wave it above the sensor or go through arm first :P . They know our story and the security guards even asked if we needed an escort to go back to England :yes:

Thank you Jill also for the response, I MUST remember that before bording the connecting plane in Chicago. MUST give I-94 back!! :) And yes, you made perfect sense!!
