Background:

My wife completed AOS (was legally in US the entire time prior to marriage on H1B) within the US based on our marriage. CGC issued Jan 2013. We also applied for CR2s for my stepchildren (9 and 11) at the same time as her AOS application but as they were outside the US, their approval were in July 2013 along with their POE and August CGC issuance. So we are about a year away from my wife's window and about 18 months for my stepchildren. Nothing weird with our case as we all live together, kids go to local public school, lots of joint account stuff, etc.

I do understand there will be separate ROC applications for my wife and my stepchildren given the more than 90day window of issuance. I have found a wealth of information here on doing the ROC for my wife so I don't think I have any issues there.

Questions:

Both stepchildren do share a 90 day window so can I put them both on the same application for ROC with additional Bio fee or do they need separate ones?

Given that they don't share a window with their mother, what "additional proof of relationship" might be sent with their application(s) given they will be both under 16? They are on our family insurance plans (medical, dental, etc.) and I am listed as their stepfather at school but obviously we don't really share financial stuff as they are kids!

Any other ideas of what I have not thought of given the background?

This is tricky - the child can be added to parents application (within 90 days) but not one sibling with other. Please call and inquire with USCIS, as this looks like a good case for consideration.

The additional proof for children would be their school records, birth records, medical coverage... and what you have is good.

01/08/13 - Approved and GC is order for production on 1/8/14

09/12/13 - Case transferred to CSC. NOA2 received on 09/18/13

08/30/13 - Biometrics Done - No walk ins allowed at this LSC (received on 8/16/13).

08/05/13 - NOA1 (received on 08/10/13)

08/01/13 - Mailed I-751 (received on 8/2/13 - check cashed on 8/5/13)

12/28/11 - Received SSN (applied on 12/20/11, as we didn't get based on DS-230 options)
11/28/11 - Received Green Card (Expires on 10/30/13) - Welcome Letter on 11/17/11
10/30/11 - POE - Houston, TX

Chennai Consulate (40 days)
10/28/11 - Received Visa papers and Passport at VFS
10/25/11 - Interview Cleared Successfully (Spouse was not allowed in)

NVC: (90 days from NOA2 to Consulate)
08/31/11 - Case Completed (Interview 10/25/11) - Received at Chennai on 09/19/11
07/22/11 - NVC Case Number

USCIS: (92 days)

6/21/11 - NOA2 (NOA1 on 3/25/11) - took a month to get to NVC
3/21/11 - I-130 sent to USCIS Lockbox, Chicago.

Thank you. Lots of time before it needs to be done but I am already starting to think of these things! I guess worse case it is just 3 different packages just as it was for their 130s.

Yes, the worst is an additional application fee of 485 for each child. But I think USCIS may consider one application for both your children - calling is worth a good try. Hope someone, who actually has similar case in the past will come up to shed some practical light.
