I have been back and forth from the Phillipines for the past 3 years. In 2011, I never made above poverty (I only worked for only 8 months before going back to the Philippines) but if you calculated my pay at full time i made and estimated 25,950. At my current payrate right now at full time i make an estimated $28,800. This is both at the same job. I am worried my visa will not be approved due to being a public charge. Or am i okay? Thanks in advance.

If your documentation can show that you are a family of two, your 125% poverty level is going to be $19,388. So having said that if your 1040 tax return for 2012 and your W-2 or a letter from your employer states that you make $28,800 now then you will have no problem passing the interview. It was my experience during our interview that the letter from my employer was the most important item that showed what I'm currently making now compared to the poverty level and ours was greater than 125% so we pass the interview with no problems.

If your documentation can show that you are a family of two, your 125% poverty level is going to be $19,388. So having said that if your 1040 tax return for 2012 and your W-2 or a letter from your employer states that you make $28,800 now then you will have no problem passing the interview. It was my experience during our interview that the letter from my employer was the most important item that showed what I'm currently making now compared to the poverty level and ours was greater than 125% so we pass the interview with no problems.

how do I show were a family of 2 I mean its only me and my fiancee. Then, I never worked much in 2012 only 2 months. I can get my employer to sign my letter..does it need to say total yearly salary or is hourly and on a full time basis okay??

Not having worked much in 2012 can cause issues. What about 2011, as USEM wants to see your 2012 tax return? You for sure will want a letter from your employer stating your yearly salary and that you are a full time employer. You may want to write a letter explaining why you were not working much in 2012. You may have issues. Can you get a relative to be a co-sponsor?

The tax documents you will present at the interview will show you are the only one as well as your fiancé. You will need your 2012 1040 and W-2s used to complete your taxes in 2012. A letter from your employer stating when you started working for them, your current income (if hourly show the per hour, if salary then have them show it as a yearly amount) and the amount of hours you work weekly.

The interviewer will base his decision on your current income so it needs to be more than $19,880 for you to pass. If it is, then you are good to go.

It is 22312 for Hawaii, but you still make more than that. It called the paradise tax, but means your future spouse won't complain about being homesick.

Ah yes Hawaii is different.... oops on my part. I wonder if they go by just the 125% at the embassy or take in the "Hawaii factor" ?

if you calculate my pay yes I make over 23,000. I will get my boss to get a letter of employment for me. I posted on fb about my situation. I always get mixed answers. btw yeah im in Hawaii super expensive here...

Mixed answers are the norm. Even here, you will get varying ideas, but if you persist, you will get the facts.

And if you think HI is costly, you should try Korea or Alaska!!

hello... hennysemitara :-) when is your interview? by the good luck! and GOD BLESS!!! base on my experienced since we have the same issue as long as you have a good 2012 TAX Record no need to worry... but if not your fiance needs to answer the WHY's ? and make sure that she'll have all the documents and letter from you stating the reason... don't worry like my fiance told me before i left the house last OCTOBER 29, 2013.... "You got this one babe!" i know she will too :-)

interview is dec. 19. i dont have 2012 tax cos i was in philippines. i hope i can pass. i got my employee letter it says im working on full time basis , my pay, and that im secure in my position. im hoping this letter will be the ticket to approval.
