My stepson's father changed his permission for the child to live in the US and he had to go back to Colombia while the custody fight went through the courts there. We initially thought it would be taken care of in 6 months but it has dragged on for about 20 months. During that time my step son has been out of the US. The child is 6 yrs old and in no way abandoned permanent residency as he was required to return to Colombia while the custody battle took place. It was decided this week and the judge gave permission for him to live in the US. Now if he returns without at SB-2 visa what will happen at the POE? Does anyone have actual experience with a situation like this?
