Hi, I'm planning to file a petition for my husband and our 3 years old son. We were married for 3 years in Philippines. I Grew up in Philippines, and last June I came back here in USA. I was not able to change my surname yet to my husband's surname so I'm still using my maiden name. Can I file a petition now even though I'm not using my married name? or I should need to change my surname first?. Thank you. Hope someone could help me. Do you think they will question me about my name?.

Thank you. My husband has a Insurance, is it ok that my name there as a beneficiary is my married name?, I mean he puts there my name with his surname. But on my passport I'm still using my maiden name. I'm planning to change my name when they came here in US. Because the first thing I wanna do is to file the petition for them for us to be together again.

leave the insurance out of it. If everything else you have has your maiden name is on all your legal documents then you are ok. Just don't said them the insurance information to make things confusing. Remember some women don't change their last name at all and its not an issue, so don't stress yourself out too much. Just prove who you say you are, and that you are married :)
