hi to everyone! we need some advice.. me and my fiance are wondering if we can still file for fiance visa this year or early next year but we have a problem about the affidavit of support..he is just new in his job..he started working last august this year..he didnt worked for how many months before because his dad got really sick..he is fit on the poverty guidelines but he still new in his job..do they need one year income tax return? i hope you guys will help me and reply for this..thank you and Godbless..

In this day and time, it is not unusual to be out of work for a while and then start a new job. But, to answer your question: yes, you can file for the I-129. Your is guy is going to need to furnish at least 1 yr., and up to 3 yrs. ITR. Make sure his new employer creates him an excellent employer letter explaining his job, that it is a permanent job, he is doing well at his job, and any other good stuff the employer can say. After filing the initial paperwork with the USCIS there will be some time, 5-6 months, before the decision is made by the USCIS to either approve or deny the petition. By that time, your will will have more time in his new job. In addition, the USCIS might correspond with your guy to ask about his job and/or assets. Also, if he has any he will want to list all of his other assets: checking, savings, any investment, property owned, etc... Best of luck!

At the embassy phase of the process - If his income at his new job meets or exceeds the poverty guidelines of the I-864P you should not have any issues. The embassy asks for the most recent years tax return (not 3 years worth), W-2 and in this case (because it will be a partial year of income) I would suggest for sure including a letter from the employer along with copies of his pay stubs.

You don't need any of that right now to start the process and file the I-129F, and this can take a few months (sometimes up to 6 months) before the petition is approved.

If you meet the requirement of having met in person within the past 2 years, have your supporting evidence of same, you should be good to go for starting the petition process.

thanks hank..it enlightened us now..coz we thought we need that when we file I-129F..thanks much..your such a big help for us..just want to ask what are the things we need to pass when we file I-129F?? sorry if i asked alot of questions..thanks in advance..
