Hi Everyone:

I was one of the old member here always geting help from VisaJourney. Ms Darnell actually helped me a lot. Here is my story.

03/10/2011 become us citizien

03/30/2011 go back to China marry my wife.

04/08/2011 Applied I-130.

10/18/2011 My wife got interview. She got denied.

reason is marriage is not real.

Got lawer for Marc Ellie. Case go back to USCIS and I was waiting for N-14(NOIR) or reactive the case and Mr Marc can help me to do the appeal.

Unfortunely, today is 10/03/2013. I still do not have N-14 or any update for my case! Sad Life!!! And another opinion from Marc. He said I should re-apply.

Now I am doing re-apply and return to the forum. Hope to communicate with the old experince people again!

Any comment with my case?? Thank you so much.

I suggest you re-apply, but

front-load the relationship evidence

and

I hope you've made several trips since the marriage date (ok, have you done 2 each year? ) as that type of evidence is useful to submit with the I-130.

what's changed since you filed? Adjudication locations, queue movement times with USCIS, form changes at NVC (worry about that later) and the Guangzhou IV Unit has moved.

Notes:

1. frontload the I-130 with bonafide marriage evidence

2. do EP at NVC, sending off bonafide marriage evidence with the civil docs, part of DS-260 submittal.

3. spend a bit of time before filing, scanning in the bonafide marriage evidence, if you've not done this already.

I know 2 years has passed, but I really hope that your INCOME LEVELS won't be any issue, compared to when you filed, the last time. I know that's just one part of the picture, but it was really sh|tty for the IV Unit to declare it 'not a bonafied marriage' way back then on interview day and doubly-sh|tty you not receive back the NOIR paperwork from USCIS.

for now, I suggest you call into USCIS, get a Tier 2 human, and ask if there was any 'returned mail pieces' on you for this prior case.

I do suggest you reread your old topic, though, as you got a ton of advice then, most still pertinent - but now that you have a solid path for the new filing, re-reading is important, IMO.

Hi Darnell:

Thank you for remember me. I would like to ask you base in your knowledge and experience .

#1 How do USCIS going to do once you are waiting N-14 or reactive the case and re-apply I-130 at the same time? Are they going to consider me as new Peition or acutally will denied my application since there is no decision make for the last application?

#2 yes, after denial, I still make trips to China, and actually just finished the wedding with my wife because last time I only get the certificate with her.

#3 nothing big changed with my filied i-130. I do have better income right now. still very low, 30k/year. It's enough to no need co-sponor for my wife?>

#4 How can I do EP in NVC but before re-file I-130.

#5 I am going to read the old forum.

#6 I only have the certificate of marriage for our evidence along with the wedding picture and video. I do not have like Joint proberty or bank account.

since you've already gotten great advice from Marc Ellis -

I suggest you hire a china college student nearby and help you with translating all of the stuff in your old topic. we've posted lots there, and I feel, if you understood what we posted there, you'd have a very clear path of what to do.

Most china college students in the USA are bilingual, so that's a plus.

I understand the old topic. That's why I did not re-file I-130 at that time. I actually do not get a very "critical" opinion from Mr Marc. He give me an answer that I think I have no chance but wait. Eventually he said you better re-file since I asked him again why takes that long to wait for N-14 or reaffirm.

So, Could you help me with my questions. Ms Darnell please??

Hi Darnell:

I just called the Tier2 human in USCIS. She confirmed that my case is in Veromont Center still processing.

I asked her if I re-file I-130 she said depend on the officer think if the officer accept my new I-130 with more evidence or they going to pull out our old case to see if reaffirm or NOIR which makes sense. So I would like to ask you what your suggestion next? Thank you.
