Hi there,

I am about to file I-129F for my fiance. I have filled out the form and I have a few questions. I got married in 2009 to my ex-wife and filed I-130 for her, and it was approved and she got her 2 year conditional green card. In 2011 we jointly filed I-751 to have the conditions removed on her green card, but after the filing our marriage broke down and we withdrew the I-751 as we wanted to go our separate ways, and we got divorced (and I have a copy of final divorce absolute). I am here now trying to file I-129F for my fiance, and in the I-129F form on page 2, item #14, it asks "Have you ever filed for this or any other alien fiance or husband/wife before?" Is it asking, if I have ever filed I-129F form for anyone in the past? Or is it asking if I have ever filed for any immigration benefits for any aliens in the past? Do I answer that as "yes" or "no"? If I answer that as "yes", it is asking me details (date of filing, place of filing & result) about my previous filings. Since I have filed twice for my ex in the past (I-130 in 2009 and I-751 in 2011), which filing do I report in the form?

1) If I need to report about the I-130 filing I did in 2009, I have a copy of the I-130 form I signed in 2009, I am sure that I mailed out the form a day or two after I signed to USCIS, and probably the USCIS received it a few days after that. For the date of filing can I use the date I signed the form (I do not have a copy of NOA I received after USCIS got my paperwork), even though USCIS got the form a few days after that? Does using this date cause any problems? For the "city aor town" they are asking on item #14.f on page 2, do I provide the place where I mailed the forms from (which would be Massachusetts)? Or do I provide the USCIS address where I mailed the form to? If I need to provide the place where I mailed the form to (I-130 form that is), which I do not remember, can I write down "st albans, VT" as I filed in Massachusetts and that is the closest USCIS processing center we have in Massachusetts. And for the "Result" they ask in the form, can I just write "Approved"?

2) If I need to report about the I-751 filing we did in 2011, I have a copy of the NOA so I know the date of filing, but I do not remember where I mailed the form to. So, what do I put in the "city or town"? Is it my Massachusetts address or USCIS's St Albans, VT address or any other address? And for "result" what do I write? Can I write "Withdrew the I-751 form"?

I would really appreciate any help/inputs.

Read carefully, interpret literally, and answer completely and honestly. Avoid overthinking. See which of these questions you can answer yourself. :)

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
