Hi



I am a little confused.


I am a student, and not working. I did file my tax return with 0 income.


I have done my i134 and on a separate paper stated why I didn't have an income.



I have a sponsor, my aunt who is doing the i134 for us.


My question is which income is she to report on i134.


She is self employed.


would she include her gross profit, line 5 on schedule c Part one (income)


or "gross receipts or sales" line 1 on schedule c part one (income), or would she report adjusted gross income line 1 from form 8879 as her income. I am very confused.



The thing is if I report her adjusted gross income I get a lower income. its off by 9,000 to meet the 125 guideline. what do I do



just report the other income form different line or what other options I have.

For self employed the income number comes from Line 22 of her tax return Form 1040. That is what immigration uses....Total Income. If she took a lot of business expenses on her Schedule C, it's good for her because she lowered her income that is taxable. However it isn't good for you if she doesn't qualify to sponsor.

You can

...make up the difference of $9000 with a lot of cash assets belonging to your aunt

...find a different sponsor

...find a job

...if your fiancé has a lot of cash assets, He/she can self sponsor.

...wait until you are finished with school and can start working before you marry.

What you can't do is pick a better number randomly off the tax return. The I-134 isn't so strict, but when you file for adjustment of status for your new spouses greencard, it is very strict using form I-864 Affidavit of Support.
