Hello Vjers,

My wife is a usc and we both got married about 2 years ago. As i speak now she is living and schooling in the U.S.

Initially before she became a student, she was working but now she is not. Meanwhile we filed i-130 and had our NOA1 already. She also talked to her friend who teaches in one of the colleges to be the co-sponsor.

Questions:

1. will she still have to fill out the i-864 as the first sponsor?

2. if the co-sponsor's income is much enough to qualify for the sponsorship, must my wife necessarily have to fill out the i-864?

2. if she must have to fill out the i-864, what will she show as pay stabs (payslips) since she has been a student for almost three years now?

3. will the nvc accept to go ahead and approve an i-130 application for spouse who is still a student?

Your wife as the main sponsor and petitioner must always sign a completed I-864. If she is not employed or did not need to file taxes she can make sure that is written on the form and also make sure she hands in a letter saying why she didn't file taxes. If her job is not enough there isn't much point in sending in pay stubs.

The NVC does not approve I-130s. The NVC will look at the AOS package, make sure the information is complete and correct and then forward it to the consulate/embassy who will make the determination on the AOS. Yes, people are accepted all the time when one spouse is a student and the joint sponsor makes enough.
