Hi Everyone,

I had a few questions. I filed I-130 for my Taiwanese wife back in May and still haven't received anything yet. I guess this is probably fairly normal, but I'm beginning to freak out a bit of course. I have everything ready for the next round, sponsorship forms, taxes, health, criminal records, proof of our relationship, emails, photos, etc, etc, but still waiting. I have several questions.

The first is question is where will the NOA2/NVC information be sent? To my address on the I-130 or the address we listed for her in Taiwan? She has since moved back to her parents home and I'm wondering how I can change the address...on the USCIS website it says you must change your address immediately if you move, but it seems to only relate to those moves made in the US and not abroad. If it is sent to the previous address in Taiwan, our landlords will forward it to her but want to make sure what we should do about that.

Second question is since she hasn't heard from them she wants to come to the US to visit me on a tourist visa. And of course if we hear from the government while she is here she will go back for the interview etc...is it ok if she comes to visit me as a tourist? What should she say to the immigration people on her arrival? That she is visiting her husband and she is applying for residency etc?

I guess lastly, is there any way she can have her interview here? Or does she definitely have to go back to Taiwan? We seem to be getting conflicting information about this!

you should have gotten a receipt notice, formletter I-797C, containing the receipt number.

as to her coming over for visit, absolutely - not need tourist visa - just need ESTA registration.

for her to interview in USA - that is not any visa chasing, that's something else.

if she is seeking spousal visa, that interview will be in Taiwan.

is rare USCIS sends anything to her via postal mail or email. It's your petition, so all notices come back to you.

You should find and study LingChe in the Wiki, for the steps for NVC processing - but even then, is rare for NVC to contact the beneficiary about something - sure there's email stuff but that goes to both of you.

Thanks very much for your rapid reply, I really appreciate it! That really helps to confirm about letters and everything, yes, the initial letter was sent to me in Boston, so I've recieved that!

Yes, Taiwan has visa waiver she registered for the ESTA so that's great. I am just a little nervous about what she says when they ask her why she is coming etc, or rather she is, like should she tell them she is married to American and coming to visit him, etc, that she has applied for the Spousal Visa etc, or just stick to tourism, etc...she thinks they might send her back because she just quit her job and that they will thinks she's lying about being married etc...

In my opinion she should say she is married and she is visiting you. The fact that she quit the job might be a red-flag for visiting but think about long term consequences. Denying entry for short-term visiting for telling the truth is better than denying a permanent immigrant visa for hiding facts.

Thanks for the reply "scienceworks" I appreciate it...that's what I was thinking for sure. I guess they probably will ask about her job right? Upon arrival? I think she should definitely tell the truth for everything, I just hope she doesn't get asked whether she is working or not...

In other words, they will ask "reason for visit"? She should just say, visiting my husband, simply the truth...then hopefully they won't grill her too much, but after that she will probably ask her why only three months etc...what about your job? I think she can also say, truthfully, she quit her job because she wants to continue her college education in the Spring, which is the truth as well, right?

Any other thoughts on this?

No actually, she has no property and she in fact is not even registered for school right now...

She probably should have kept her job but wanted to come visit for a while and we were hoping that the visa stuff would be resolved soon after that, but I'm thinking according to estimates that we may not hear about the initial I-130 application until December anyway...
