I have an big issue my Fiance has a student visa and he is currently studying in the UK. If the K-1 does not work out for us for any reason plan B was for me to go live there while he studies and I can work. But he is also in the need to apply for his student visa that expires soon and they will need his passport.just like they will need his passport for the K-1. Is there anything I can provide like copies of his passport in the meantime? Is this something that can be explained to them while he gets his passport back? Or can they request it from the UK Border Agency? I'm really confused and a lot going on, I'm not sure what to do at this point. I wonder if they will understand or help me with this the US Embassy in London...

Please Help! Is there a number that we can call and talk to a live person at the London Embassy or is there just a switch board number? I have had no luck with an email either.

1. Who is who? Who is the US Citizen, who is the UK Citizen.

2. The "Plan B" option is illegal from what I understand you are saying. You can not enter a country with the sole purpose to kill some time, get married and adjust your status. It isn't impossible, but it is certainly riskier.

3. You need your passport for the K-1 visa interview and any entry to any country... There is no way around not having a passport at an airport or visa interview.

4. I don't understand why you are planning to do both at near the same time. Once he is in the country (guessing he is UK citizen) then you have two options. Either file an AOS there.. or apply for K-1 visa. You dont need to be in the UK to file that.

You will need to break down your situation a little bit if you want a better response I would imagine.

K1 AOS:

May 22nd: Sent away AOS package Day 1

May 27th: Notification via text/email confirming receiving package. Day 5

May 29th: NOA's recieved on 29th May Day 7

June 2nd: Biometrics appointment for June 16th arrives. Day 11

June 16th: Successful Biometrics. Day 24

What? There is nothing illegal. My Fiance has been studying in the UK for over 3 years now. Way before me and him connected again and got into a relationship. Well we really want to start our lives here in the U.S. but God only knows what can happen it's not a guarantee. So his student Visa in the UK is close for it's renewal time also. It was not planned this way, but we had no idea how long exactly this process would take. And we can't just stop our normal lives waiting. So he has been studying in the meantime. He wants to continue his school there if this Visa does not go like we would like and plan B would be for me the U.S. Citizen to go live there with him. No he is not a UK citizen. He is there with a Student Visa.

Look up MARM. She put her saga in her timeline, but we followed it on VJ in the UK forum. UK home office kept her fiance's visa 7 or 8 months when he sent it for renewal and he had to postpone K1 interview several times for lack of a passport. He tried everything to get his passport back.

So where is he from? I don't see how having a visa to study in the UK would stop you filing for a K-1 visa. Your original post, and this one doesn't really clarify anything, and both are quite confusing, so excuse me if I misunderstood. I am merely trying to get you to break it down a little so we know what you are saying.

So answers to questions like the following would be helpful.

Who is US citizen? (You)

Is he legal to work/study in the US?

If he is legal to work/study in the US, when does this expire?

Are you, the citizen, planning to stay in the US? (If not, I believe you are on the wrong forum, and not many here would be able to help)

He is from Morocco and has been studying in the UK for more than 3 years now. It has not stopped us from filing the K-1. We applied because we really hope to get Married here in the U.S. and live here and start our lives here since all my family is here too, work, etc. Our K-1 got approved and it's now waiting to get processed at the London Embassy. The worry that we are having is; like you must know our lives have to continue while we processed this K-1 also not knowing how long this process would take or if we will get the final approval for him to come here; he has continued on with his studies paid for school and taking courses in the meantime but his Student Visa will also need to be renewed sometime soon. He wanted to go ahead and apply for this since we still don't know how much longer it will take. As a couple we decided that our plan B would be for me the U.S. Citizen go live with him there in London work get Married and try to regroup ourselves after waiting so long already; if we didn't get the K-1 Visa. God willing what we really want which is to start a life in the U.S. along side my family can happen... When he reapplies for his Student Visa that means the UK Border Agency will need his passport as well. So they will take it, we are afraid that while they have it we will be asked to set the interview and he also has to present his Passport there. That is the conflict; We want to Marry sometime in the Fall I was hoping for September or October but we are waiting for Packet 3 at the moment. I'm not sure if this clarifies things.

No I am the petitioner, the U.S. living in the U.S.

My Fiance the beneficiary is the Student in the UK, not a UK citizen from Morocco.

Thank you is there a link to his or her timeline I tried searching for it but I didn't get anything. I would love to read about their story. My Fiance when he last renewed his visa in the UK, like 2 years ago... he said it only took one month for the UKBA to give him his passport back. So we are hoping within that time frame we are able to fill out the K-1 forms in Packet 3 gather things for the Medical etc. and have his passport back from the UKBA before he has an interview set....

OH so he's not a UK citizen just having his interview there because he's going to school there currently. I understand now.

Yes lol I feel like I'm out of breath trying to explain but yes he is a student there and having our interview there because he is a student. smile.png

It's a lot more complicated for you to move to the UK than for him to move here ;)


You can always reschedule his K1 appointment if necessary but he needs to have legal status in the UK to interview there so I would think that would take priority?

Correct we want to do things the right way and not just have him stay there illegally while we wait for the K-1. Plus his School is also important and has been paid for, so he can do that while we wait. I have all my faith in the K-1. Yea it would be a lot of more complicated that would mean a whole another wait and process... :(

Many people have to spend time apart on K-1. It is such a pain-in-the-backside visa.

Is there anyway for him to extend his visa without handing in a passport? Might be worth having a discussion with his schools immigration personell.

Hope everything works out for you. Just remember, anything worth having, don't come easy... Be patient, any wait you will have will be a relatively short one in your life together.
