Hey guys!

I'm helping my husband file for the CR-1/IR-1 visa via I130.

Today we received the NOA2 (approval letter) in the mail. It came though EXTREMELY fast.

So we're trying to get everything else, seeing as how everything is moving SO quickly.

My mother is going to be our financial sponsor. I was told we have to fill out an I-864 form for her which she has to sign as well.

However, the form is extremely confusing. Anyone have any links to an example form for a joint sponsor? As well as for us?

I know filling it out incorrectly can lead to denial so I want to make sure we get it right.

There are example forms if you look at the menu bar of VJ. However, the I-864 format has drastically changed and VJ doesn't have the new version posted. Read the instructions over about 3 times and you might get it.

You fill out one from the American spouse's point of view. Mom fills out her own and it has nothing to do with your form except the same immigrant. If you do Mom's for her then answer as if you are Mom.

Name, address?

How many in you household?

What is your income?

It is pretty straight forward. Use the separate instructions for help. Which part is confusing you?

So the I864 is from my mom as the joint sponsor, and from me as the american spouse? My husband doesn't need to fill one out?

You the American spouse must do one. Put all your information and income in. Include 2012 tax return.

Mom fills out one with her info and income. She includes 2012 tax return and any other proof of her income like pay stubs or employer letter. Plus proof of her US citizenship...birth certificate or US passport.

Mom must make enough on her own. If she doesn't then there are other options.

I'm not at this step yet, but hopefully I will be soon. I already know I will need a joint sponsor. I had my dad look over the form and his question was: Does he provide the numbers just as he filed his taxes? My mom and dad both have income and file their taxes jointedly with my dad as head of household. So is he going to be using the same sort of numbers as it pertains to income and household size, etc? Also will we need to provide proof of citizenship for both him AND my mom since the income amount reflects both their work? And also provide paystubs from both of them?

Also, I know I need to fill one out, but I fill it even if I'm not working (as I'm living in India and not permitted to work yet)? Tho I may be working by the time this step rolls around.

I'm going to have my mother send over her birth certificate, tax forms, paypal invoices (she's a web artist/book cover designer) and bank statements, maybe even her rental agreement. Is there anything else she will need to include as a joint sponsor?

2012 tax return

Trust Fund Statement? Do you get regular income from that? You may use that to show your income.

Proof of domicile in the US or intent to domicile in the US. Read the link I gave you above to a "bible" for DCF London, written by someone who just completed it.

Joint sponsor provides

I-864

2012 tax return (Her line 22 of the 1040 must show enough to sponsor because it sounds like she is self-employed)

Photocopy of her US birth certificate

The British person getting the visa provides original documents

Interview appointment letter

Passport with at least 8 months validity left

Birth certificate with parent names on it

Police certificate. Add subject access report or court records if it says anything but NO TRACE

Marriage license

Previous divorce decrees

Just go down this list starting under Document Checklist http://london.usembassy.gov/iv_interview_documents.html

Generally they don't ask for photos because most files have a few from the I-130 submitted to the US address. Take a few in case they want to add them to the file because you probably didn't include them with you I-130 filed in London.

Also, if she's earning above $30,000 does that put her over the 125% limit?

Mom counts herself (1), brothers(2), no to sister, Immigrant (1). So far a household of 4. Anybody else like a Dad?

Both do I-864. No I-864A.

I thought you live in England with your husband?

Read the London DCF stuff. It points you to the domicile info. It tells you everything about London DCF. Ask a question in that thread so the expert can answer you.

Yes. My guide points off to the London FAQ about domicile. Note this passage in particular from http://london.usembassy.gov/faq_i864_domicile.html

In order to file an I-864, the sponsor must be a "resident" of the United States as described above. If you do not maintain a residence in the United States and have no intention of re-establishing a residence, there, I regret it will not be possible for you to act as sponsor. If you cannot act as a sponsor it will not be possible for your relative to qualify for immigration on the basis of an immigrant visa petition filed by yourself.

Remember, you are also filing an I-864, even if it shows $0, therefore you must also show that you either have US domicile, or are intending to re-establish it. You may want to see other UK DCF filers who are about to go through/have done the process of showing domicile.
