Hello everyone, my fiance just applied K-1 / K-2 visa for me. What I am worried about is if my son could succeed getting the visa and the green card since he will be 21 years old next June. He is a college student now, and will graduate from college in two years. If he couldn't get a K-2 visa, is it possible for him to apply for a student visa for his Master study in the US?

I heard if the child of over 21 years old has a parent who is a US permenant citizen, it is impossible for him to get US visa other than immigrant visa. But on the other hand, if his parent petiitons for immigrant visa for him, it will take at least 8 years. It makes me very frustrating.

What should I do about it? Thank you very much.

You have no timeline, so I do not know where you are in the process. The K-2 would need to apply to adjust status before turning 21. That is less than a year away, so if you have not even started, I do not think it is feasible for that to happen.

This page has lots of info on the K-2> http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=fcf75b836ea73210VgnVCM100000082ca60aRCRD&vgnextchannel=3d7fa6c515083210VgnVCM100000082ca60aRCRD
