Hey

Does anyone know if the 87 day deadline include weekends or not?? Basically i was told because my RFE has gone past 87 days (including weekends-i never asked the customer service representative) is gone, i have to wait for a decision, and to not even bother writing a letter explaining why i was unable to send the RFE in time (reason being that im waiting on an I-824 to be processed and information to be sent back to me so i can then send back all the RFE info).

It is 87 days from the date on the RFE.... if you have failed to send the evidence thay have asked for you will be denied your AOS and will be asked to leave the country...

You need to make an appointment with an immigration lawyer ASAP to work out if there is any options for you other than leaving..

Even if you had written and explained you were waiting for info to come back they could have extended the time... but as it is now past the 87th day it is too late...

I have been in touch with my local district office, who are now handling my case and they have informed me that everything should be fine. I have done everything legally, came in on a K-1 visa etc and got married within the time frame, and i had no idea i could extend the 87 days, it does not say that on the yellow papers you receive with the RFE and also its not like the call centre informs you of these things until it is too late anyway. Thus, deportation is a bit drastic when given the circumstances..im waiting on my I-824 to be processed in order to give them the required RFE for the I-485.

03/09/07 - Email notice: "Notice mailed welcoming the new permanent resident"

03/13/07 - Email notice: "Card production ordered"

03/19/07 - Permanent Resident Card and "Welcome to America" notice received!!! Yahoo!!!

We unknowingly went over the 87 days by a bunch. The RFE was lost in the mail. We found this out by going in for an interim EAD and were told we couldn't get one because our case was on 'hold'. We ended up getting the RFE resent and we submitted our stuff.
