I am an American citizen living in my home country Bosnia with my husband. We have been married since December 8th and filed in the month of Jan. We got rejected because of the $420 fee. We sent the check from Bosnia and instead of the date on the check being 1.8.2013 it was 8.1.2013 (European format) and they did not accept it. Stupid mistake. Everything else is OK and we re-sent it and got our receipt number at the end of Feb. Since then, nothing is going on. When I call, they tell me it's in process and everything is OK. I am wondering is there any way my husband can come to America with me and wait with me there until he is approved? I read about the k-3 visas. Should he apply for that?? Can someone explain who has gone through something like this? Thank you!!

There is no way for your husband to come and wait in the US.

The I-130 you filed for the spousal vis is the best option.

The K-3 takes as long as the spousal visa. Furthermore, it requires a second process called Adjustment if Status which will cost more an leave your husband with 2-3 months in the US where he cannot legally work and traveling outside the US during this time means he abandon his application.

Be patience. You are on the best path right now for him to immigrate to the US.
