I'm a green-card holder, and going to file for my husband for F2A immigration.

Both of us are Canadian citizens, currently he is working in US under TN visa,

He has a 14-year-old daughter living in Canada, he has 50% custody, his ex is a tough Canadian women so wouldn't agree to give full custody to the father.

My questions are:

1, If I only put my husband on I-130, how can we bring the daughter to US later?

2, If I put both my husband and the daughter on I-130, is the full custody required? Is the full custody enough? I mean do I have to adopt her through a legal process?

3, Can the daughter choose her custody in the court?

The daughter is thinking about coming to US for study, but doesn't want to irritate her mom (poor girl), so we want a best solution to minimize the pain for her.

4, if I submit I-130 for my husband, can he still work in US under TN visa before he gets the green-card? (he has 3-years TN visa)

Really appreciate any comments

1. Once he is a greencard holder, he can petition her.

2. Full custody and the mother must allow the daughter out of the country.

3. That depends on Canadian law, consult a good divorce/ custody attorney

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
