Hello,

My wife and I will have been married to each other for 5 years next month. We have an 11 month old daughter together, who was born in the U.S.

I lived in the U.K. for four years on a visa.

I came back to the U.S. to get us settled here but things have been rocky... I haven't seen my wife or daughter since November 2012, it has been 8 months...

I'm trying to get my wife and daughter here to the U.S. but the whole process is very confusing and every time I think I have all of the forms, I see a list of more forms...

I can't seem to get a straight answer, maybe I'm stupid, whatever the reason can someone please just give me a straight answer? What steps do I need to take to get her here?

What have you done so far? Have you begun a petition and visa process?

If not, you just need to follow this guide to petition for your wife (no need for daughter as she was born in the US so is USC): http://www.visajourney.com/content/i130guide1

That guide will allow you to petition to get your wife an IR1 visa, which provides her with an immediate 10 year green card upon US entry.

7th May 2013 - I-130 filed
4th June 2013 - NOA2 (approved)
16th July 2013 - Interview (approved)
30th July 2013 - POE San Francisco
29th August 2013 - 2 year green card arrived

I don't have a salary, I earn $8.50 an hour. In a best case scenario I would earn $17,000 per year.

If what I read is correct I need to earn $24,000 per year to sponsor them.

I can't go to the UK and she can't come to the U.S. because we are poor?

I'm very pessimistic about this whole situation, my life has been an absolute nightmare for over a year now.

I just want to live a normal life with my wife and daughter.

Am I just wasting my time filing for something I can barely afford to pay the fees for? I'm trying to save money but a huge portion of my money goes to the U.K. to pay for her and the baby.

I wouldn't even have a place to live or anything if it weren't for some help from my family who also are poor.

I'm working 40 hours a week trying to find more and better work without much luck. I would need to work over 100 hours a week at $8.50 an hour just to pay for the "fair market rent" in my state, but my boss won't let me have overtime.

If you don't make enough money you just need to find a joint-sponsor who does. Can be anyone over 18 in the US who is a US citizen or legal permanent resident.

My fiancé also does not currently earn enough because he is still in school. So we have told ourselves we have three options. We either wait until after school and he will hopefully be earning enough, he takes a second job or we find a joint sponsor. You have to do what you have to do.

My fiancé was more than happy to take a second job to make the required amount but fortunately we have a joint sponsor so that when we are married in a few months we can go that route.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!
