Upgrading I-130 Petition from F2A to IR1

Hi All,

Finally after long waiting, I have Naturalization oath Ceremony letter in hand. I will take oath on July 12 in local public Library.

My wife's I-130 PD is Feb 20, 2013 and its currently pending at California Service Center.

So what happens when I call Customer Service on July 12, 2013 ? Will CSC start processing my wife's I-130 or CSC will send it to my local field office ( Chicago)?

I guess it will be very bad luck for us if our I-130 application goes to Chicago field office because the office is very slow in processing applications and also we might have to stay in queue forever.

If you guys have any thoughts or similar experiences please share with me. I will really appreciate your thoughts/comments on this case.

You can call and talk to them - but i am pretty sure they will need proof....

I sent a scanned copy of the naturalization certificate to them to upgrade my case.

Once thats done - they will sent a I-797 notifying of the update and which classification it is now in.

I just realized - did you get your NOA2 yet? If not - then you will also get that i presume...

Thank you very much for your response Lubnajavid, I really appreciate it. I will also email CSC with scanned copy of naturalization certificate.

I have not got NOA2 yet, still waiting.

I am really afraid that CSC will send our application to Chicago field office, because Chicago field office is really really slow I don't want to wait any more, 16 months of wait is enough amount of wait to get united with legally married wife.

Our case was already at the NVC.

We waited over 26 months from time of marriage to time of interview - so i know how you feel.

I guess you have only received a NOA1 so far? and you are waiting on NOA2 (I-130 approved)?

If you are waiting for the NOA2 (which is processed by the local service centers) then you will have to wait for that i think...

Being a naturalized citizen only means not having to wait for the visa number, once the i-130 has been approved...

I am still waiting for my NOA2. Looks like CSC is processing randomly. Some VJers whose PD is on June/July 2012 have already got approval from CSC but I although my PD is 20 February 2012, I have not heard anything. If CSC send this I-130 to Chicago field office then I guess I have to wait for another 8,9 months to see her here

I wish CSC may approve our I-130 before I take oath.

I may be wrong, Chicago may be fast for processing I-130 petition. I am saying Chicago is slow because of my experience of N-400 Application with Chicago field office. It took me 10 months from the submission of N-400 form to oath letter. I am crossing my finger, hopefully even if the case goes to Chicago field office, they will process our I-130 soon and I will be able to see my wife soon here.

Looks like your case is also pending at Chicago field office, I wish you all the best and hope you will get your NOA2 soon

No, my case is not pending there.

My case was approved there after 132 days or slightly over 4mos

Its been more than 16 months we have been separated. I wish CSC would approve my case when I request for upgrade rather than transferring my case to local field office. Few VJ members, who are in F2A category and PD is even later than me have been approved by CSC, hope CSC will have mercy on us and will approve us rather than transferring our case. 16 months of separation after being legally married is really hard to handle, really miss my wife here

Given that your application was filed before the transfer date, I highly doubt they would transfer to the local office.

It just doesn't make sense.

Especially since NBC is the one doing the transfers, not CSC.
