I601 Waiver for overstay

Hi All,

Here is the latest updates on our case, My fiance went to his interview, the consul told him to submit a waiver

the section she checked is Section 212(a)(9)(B)(i)(II) Unlawful presence in the U.S. for a period greater than one year, You are therefore inadmissible to the U.S until June 2016

Then she check , He is eligible for a waiver

My question and please if someone can help me

What waiver should he apply for the I-601? or I-212? or both together?

the i601. the i212 is for deportation. since he wasn't deported he will only flie the i601 and you will submit the hardship letter with the form and payment

This forum is for ppl to ask questions..no matter how minor

if they re-ask I think they don't quite get it, so lets just be kind.

A I601 is really not a DIY endeavor so at least consult a lawyer

who specializes in waiver before you begin.

The waiver will be sent to phoenix where its open process in

acceptance & forwarded to Nebraska, if unsigned, lack the

correct payment amount or done on wrong form it will be returned,

a new I 601 came in effect about 4 months ago .

You will have to argue and prove hardships to the USC, show why

the spouse have to return, country condition etc, medical problems

the USC may have carries some weight, however regular depression

or missing the person alone in itself does not count.

I 601 is needed for the overstay & if spouse just up & left was never

deported, nor given VD by immigration they do not need to file i212

At least consult a lawyer..Happy holidays
