So, my past marriage failed... No need to go into the details, if you want, then ask, but I say that because if you look at my profile you'll see the info for my ex. Our divorce will be able to be finalized February 2014.

So, this below is certianly not set in stone, however I want to proactively know options...

Since our separation, I have come across another wonderful lady and we've really hit it off. She is from Philippines. However, she currently resides in Canada on a work visa. Her work visa expires January 2014. So timing really works out for us.

She's not sure what will happen regarding her work visa, should she try to get an extension? Should she go back to the PI?

If she is in Canada on a work visa, will I still be able to petition her on a fiance visa? Since she is in Canada it's so close I can go visit her easily from the US and not require a visa, all I need is a passport.

Thanks for any advice on planning ahead.

If her visa expires that fast she wont be interviewing in Canada unless she has a valid visa status of working or student. If you want her to stay there for the interview she must keep her work visa valid at all times, be following the rules and maintaining her status correctly.

If she has legal status in Canada (i.e. work visa) then she is able interview in Canada at either the Montréal Consulate or the Vancouver Consulate depending on which Province/Territory she resides in.

If you want her to interview in Canada, she will require an extension to her work visa as you cannot petition her until you are legally free to marry and as per above she needs to have legal status in Canada.
