Help!!!

My wife(USC) resigned in March 2013 in the Establishment she was working with in order to relocate back to US before her EDD.

She aint working now until sometimes in Sept, my questions:

  1. Can she use her previous income? if yes ,she has no Federal Tax cert.
  2. Am (beneficiary) a salary earner but does some personal business which fetches me extra income, in filling I-864,should my wife add my salary and the extra income together in answering PART 6c?
  3. If the answers are YES, are there any document(s) that may be required as regards Income?
  4. Since we have a Joint sponsor, is it still necessary that my wife I-864 meets the Poverty line?
  5. Should Part 6 #11 be left unchecked while #12 is checked
  6. Should my wife(petitioner) leave Part 6 #13 unchecked since she is not working presently?

Help!!!

My wife(USC) resigned in March 2013 in the Establishment she was working with in order to relocate back to US before her EDD.

She aint working now until sometimes in Sept, my questions:

  1. Can she use her previous income? if yes ,she has no Federal Tax cert. She isn't working so se has no current salary. So NO
  2. Am (beneficiary) a salary earner but does some personal business which fetches me extra income, in filling I-864,should my wife add my salary and the extra income together in answering PART 6c? No you can not use your salary.
  3. If the answers are YES, are there any document(s) that may be required as regards Income?
  4. Since we have a Joint sponsor, is it still necessary that my wife I-864 meets the Poverty line? Yes she is still your sponsor so she has so fill out and make sure her last 3 years taxes are complete.
  5. Should Part 6 #11 be left unchecked while #12 is checked NO
  6. Should my wife(petitioner) leave Part 6 #13 unchecked since she is not working presently?NO

Your question #5 and #6 is about joint sponsor. Are they living in your wifes home or does she claim them in her household number thats what that question is for. I

Your wife will have had to file her 2012, 2011 and 2010 taxes. I would write a coverletter to explain her employment situation. But since you have a joint sponsor it really isn't an issue whether she has a job or not.

To correct the above:

  1. Since we have a Joint sponsor, is it still necessary that my wife I-864 meets the Poverty line? Yes she is still your sponsor so she has so fill out and make sure her last 3 years taxes are complete.

No, she does not have to meet the poverty line if you have a joint sponsor, but yes, she still have to fill out the paperwork and turn in her tax info.

Thanks for your responses.

She worked in Nigeria until March 2013 when she had to relocate to US.She hasn't worked under US Tax laws before. What may we do about this?

Then she needs to write a letter stating why she was exempt from filing taxes in the US for the past 3 years
