Applying for a short-term work visa while IRI is pending

My husband filed an I-130 on my behalf in January 2013 and we are waiting for the NOA2 from the National Benefits Center, but I have not told my employer yet. I wanted to wait until the IR1 visa was confirmed just in case anything happened along the way.

Recently, my boss suggested a "fantastic opportunity" for me to spend 8 weeks on rotation working out of our company's office in California. Our HR department says a visa will be likely and have offered to make all the arrangements.

1. Will a short-term work visa affect my I-130/IR1 application?

2. Will my employer find out about my I-130/IR1 application when filing for the work visa?

1. Since you clearly have immigrant intent, your immigrant visa petition might be relevant here

2. Possibly, why haven't you come clean about it yet?

I haven't mentioned it because my employer pays small semi-annual bonuses on top of our salary. The bonuses are discretionary and I'm concerned that if my boss knows I am planning to leave, my bonus will be lower.

My guess is that you'll have to come clean about this. There are questions in the applications regarding whether you have held or applied for other visas from what I recall. Assuming they will have similar questions in the application for you it would seem detrimental to your immigration application to have false information in the work permit. Obviously being able to be with your loved one is more important than a financial bonus from work. If you can "have your cake and eat it too" then great, but if not it seems you might need to be sharing this very important information with your employer.

Probably not the news you want to hear and I'm certainly not an expert but my guess is that you need to let them know so as to not jeapordize either application.
