K2 BC and Passport name issue

Timeline

Fiancee's sons birth certificate has his middle name (her maiden name) misspell as Terres vice Torres. On all the paperwork I spelled it as Torres. His passport though shows Terres too. She has already started the process to get the BC fixed but it won't be ready till end of June and the interview is scheduled for 4 June.

Can she do a notorized affidavit on the name issue so the Visa is correct and then we can correct the passport at a later date once the BC is corrected by NSO?

Was really hoping to fly them here on 3 July if approved at the interview on 4 June.

Thanks is advance on any information anyone has on this issue. Especially if it is first hand information because you had this issue yourself.

Seriously doubt it. I believe you will have to get the BC and passport corrected before.

Did he just get the passport/BC or no one ever read them before to notice the misspelling?

Be ready for a delay. FYI you can extend the petition allowing for the K-1/2 visa for up to a year by contacting the embassy. And the K2 can be processed up to a year after the K1 is approved.

Well, guess we hope she gets approved and he gets the green sheet or whatever color it is for correct BC and passport. Good thing he is 18 and can act on his own to take care of this and follow at a later date.

We are waiting for the USCIS approval before i realize that we do have a problem on my child's birth certificate.

So i filed a correction for the BC and im pretty sure it will be done before my interview if so.. what did you guys do. thanks so much ..

He came here with his middle name spelled as Terres, and we got the corrected BC after he got here. We just got done with doing the AOS with the name still wrong. Now to work on correcting his PI passport first and then his green card.
