refiling for I-130 at USCIS how long will it take to get approval?

My husband refiled for I-130 at uscis last wednesday May 8, 2013 , how long does it take to get a NOA1 and NOA2 at the NVC? Would it be faster this time since we had a record at the USCIS and NVC before?

May 10, 2013 : Priority Date
May 14, 2013 : NOA 1
Nov 20, 2013 : Received text/email status update that case transfered to other office
Nov 21, 2013 : Received text/email status update that case transfered to local office
Nov 25, 2013 : Received hard copy of transfer notice from Nebraska Service Centerec 20
Dec 20, 2013 : APPROVED
Dec 24, 2013 : Received text/email status update case shipped to NVC/DOS

For the I-130 petition, it usually takes about 1-2 weeks to receive the NOA1. It takes up to 6 months for NOA2. Some petitions are approved sooner...some later.

IMHO, I do not believe it will be approved faster if you had a previously submitted petition. Supposedly, USCIS processes in the order they receive them (after background checks).

If you don't mind me asking, what's the reason for refiling?

For the I-130 petition, it usually takes about 1-2 weeks to receive the NOA1. It takes up to 6 months for NOA2. Some petitions are approved sooner...some later.

IMHO, I do not believe it will be approved faster if you had a previously submitted petition. Supposedly, USCIS processes in the order they receive them (after background checks).

All I-130's go to the NBC now. Then it will either stay at the NBC or move to the local office of the USC.


USCIS - 66 days ROC - 139 days from sent to approved
12/3/2012 - I-130 delivered to Chicago 5/20/15: mailed I-751 package to California office
12/4/2012 - NOA1 NBC (Missouri Service Center MSC) 5/22/15: Date on NOA1
12/6/2012 - Check cashed 8/26/15: Bio appointment

12/8/2012 - Received paper NOA1 10/06/15: Received Email card was being processed
12/20/2012 - Case number showed up on USCIS website
1/29/2013 - Called USCIS and case is still at NBC

I advise giving it about two months and then call every two weeks to inquire about your case.

Mine was at a local office in a month and I was able to go to the office for a check in about it.

Plenty of horror stories of people not receiving rfe's and the like, so calling and speaking with an IO not a CR is the best way to stay on top of it now.

Thanks for all the replies. I will tell my husband to call and inquire. And one thing is bothering me, my husband haven't received the noa1 yet or hard copy of I-797 until now. Uscis emailed him May 13,2013 and said to wait 7-10 days to received it..but until now nothing. We're just hoping he will receive it until friday.

Good day everyone!

Our case status before June 17 was INITIAL REVIEW

Then yesterday our case got another posting, it said there... they sent a document to my husband but they did not say what document it is. And there's no case status there anymore...the initial review is gone.

Is that normal? Any idea what document could it be they sent to my husband?

don't go crazy over it

some updates are just unexplainable

usually means your case was touched.. touched? who knows what that means sometimes

have you checked the volume at the local office yet? this will give you the best indicator since your file will probably head there

spend some time searching the threads all of your questions and answers are there several times over

sometimes nvc and uscis is confusing, we filled our first petition last 2007 but because of lucking documents we didnt continue it, last year we asked them if we can continue our 2007 petition and uscis and NVC replied via email that case was terminated after one year without contacting them, so we refile last september 2012 and approved last dec. 3. but last february 2013 we got an email from uscis that our 2007 petition was approved and forwarded to NVC! but we din't touch our 2007 anymore we just go with our recent application.
