Hello! I was hoping someone could give me advice on my odd situation. I am an American living and working in Japan. My fiance is Indian and he lives in India. We initially started off as pen pals due to our common interest in Japan a year ago and it has developed into a relationship at the point we wish to marry. He has tried to get a job in Japan for the last couple of months to no avail. Due to our economical situations we have not met in person yet, but want to file petition for the fiance visa. I have taken screen shots of our call logs and facebooks. Also, I have taken shots of conversations with my friends and have asked my mother (who has talked to my fiance) to write a statement stating she knows the history of our relationship.

Can anyone give advice if you have ever found yourself in a common situation? Our plan is to file the petition and for me to relocate back to the USA once it has been approved (all my money would be tied up into relocating and saving for our future). He is also looking for a job in America now.

If you do not meet in person before filing you will be denied, regardless of relationship evidence you send.

One of the main requirements is to have met in person within the last 2 years before filing.

Your interview took 67 days from your I-129F NOA1 date.

No personal meeting, no K1 visa. USCIS is pretty firm on that from what I've seen.

And the chance of your fiancé finding a job in the US from India is a pretty daunting endeavor, to say the least. As the US petitioner, it will fall to you to prove financial ability to support. Good luck!

Economic conditions does not meet criteria of extreme hardship btw. The process itself is not cheap and you must be able to prove that you will be able to support your foreign fiance(e) once in the US, so saying that we didn't meet dut to economic conditions is not a valid excuse.

Thank you for the replies :) We have decided we will wait while he continues to study the Japanese language and hopefully then he will be able to find employment in Japan. In the meantime, I will try to find a way to visit him before filing the papers.
