Hi,

I have been married to my wife in U.S for two years, however we have not filed the papers since I did not have the income to meet the minimum requirement. I filed my taxes last year and now I meet the minimum requirements.

I got into an accident three days ago, broke my leg, and had a surgery on my leg. I want to know if I apply for Gold card (it's like a government program to get free healthcare for low to no income people) since I'll be out of job for the next few months, will that affect the filing process?

I have heard that if I receive assistance from the government, that will be bad for the marriage filing.

Please help.

Thank you

Are you petitioning for the I-130? Can you please provide more details on your case such as what you are petitioning for? What is the background of your situation? Where are you, US or another country? Are you the US Citizen or is your wife? What do you mean marriage filing?

I'm confused. How can you meet the minimum requirements if you are receiving financial assistance from the government?

You also need to supply more information about your situation for people to be able to help you.

I am in U.S., and my wife is here also, she was in student visa, and we got married two years ago in US, we are here. I am a US citizen. I don't know what the next step is, I just want to get the filing don, but I want to make sure if I apply for gold card, it won't affect the filing process since I am getting support from government (the gold card)

Thanks everyone for your input, I greatly appreciate it

Shouldn't be an issue. Sounds like you'll need a joint sponsor, though, to meet the requirements for the affidavit of support.

Spouse-based AOS from out-of-status H-1B, May - Aug 2012

Removal of conditions, Aug - Nov 2014
