Hi,

My husband and I were married two months ago and we have just mailed off his entire package of AOS documents. He is applying for AOS from a valid F-1 visa with no overstays. I am a US citizen.

However, he was given an internship overseas for this summer, and will leave in approximately 94 days to begin his internship. We filed the I-131 with his AOS papers. Should we request an expedited approval of his AP?

Judging from the average timeline of AP approvals, we would barely make it with the 90 days, and as far as actually receiving the AP paper, I will be joining him for his last two weeks of the internship and I can bring his AP with me (so no worries about losing it in the mail!).

I am extremely concerned about not receiving the approval of the AP in time.

4/20/13 Entire package sent (I130, I485 and supporting documents)

5/16/13 NOA-Entire AOS Package (I130, I485, AP, EAD)

5/29/13 Successful early Biometrics walk-in (one month early)

6/14/13 RFE Received for I485

6/19/13 RFE Accepted for Review

6/25/13 Application Ready for Interview Scheduling

7/15/13 Combo card EAD/AP Arrived in the mail

8/15/13 INTERVIEW

8/20/13 AOS APPOVED!

8/26/13 GC ARRIVEDl kicking.gif

6/1/15 I751 Package Mailed

I would wait a couple of months, hoping for a quick approval. Once you have less than 30 days to go, and no AP/EAD yet, make an infopass appointment, bring proof (letter of internship etc), and request emergency AP>

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
