We filed the I-601 in September 2012. I am the US citizen and my wife is from El Salvador. After months of waiting, on march 28, 2013, the status was changed on the USCIS website to "Request for Evidence". Today I received the letter. It is addressed to me and it is entirely in Spanish. Why wouldn't USCIS send this to me in English? This is the exact same letter that was given to my wife 7 months ago when she was told that she needs to file the I-601. The only difference is that now there are 2 boxes that are checked. Last time there was only 1 box checked. The boxes that are checked are the 2nd & 4th boxes of the letter.

Section 212(a)(9)(B)(i)(ii) - Was checked on the first letter and checked again on the letter that we just received.

Section 212(a)(6)(e) - Checked on the letter that we just received

Section 212(a)(6)(e) relates to "Smuggling".

Now what? How do we respond to this? Am I being accused of smuggling? Is she being accused of smuggling? Obviously I need to talk to my lawyer. Does anyone have any experience with this? I am guessing that calling the USCIS Customer Service Center will provide the usual help that give me.

No. Sorry. This form, which I think is the form that they give you when you are initially denied, does not ask for any information. It just tells you that you have been denied for the following reasons and you have a right to appeal by filing the I-601. They do not give you any specifics and they do not tell you what information they are looking for. I have no idea why they believe that my wife or I was involved in "smuggling". I do not understand why it took them 6 months to tell me this.

Yes. She entered without inspection. I do not have any details about here entering. It was many years ago and it was before I met her. She entered the same way most people enter without inspection. Does anybody here have experience with the "Smuggling" box being checked on their letter?
