Hello to everyone! Has anyone faced this problem. USCIS received our RFE reply more than 60 days ago. They asked just for one passport photo, and that was it. We don't understand why it takes so long. Calling them doesn't help to clear the situation. Just need some advise.

What do they say when you call them?

Well. That they are still processing it, then they promise to finish it "this week", but this is what they say every week, last time they said that they had finished checking background and it should not take long, but this is their general answers. They don't clear up things. We get standard replies every time. They just apologized and said they were working as fast as possible

I do not know. The person that usually answers the calls has no further information than what you already have. All i know is that others say to ask to speak to a tier 2 and they usually have more information. I think 60 days seems a long wait after an RFE but I suppose it depends on what the RFE was for.

As i said before they just asked for one passport photo, everything else was fine. The person who talked about our case seemed quite confident about things. Anyway next time we'll ask a tier )Thank you

It really depends what you filed for. You have no timeline and have not provided any other additional information besides my fiance and I received an RFE and responded to it..

Im going to guess you guys filed the 129F? It seems like you forgot the passport photo of the USC in the initial packet?

Im assuming you received your NOA1 when your package was accepted and now your inquiring how much longer until we get our NOA2 because they got our RFE.

NOA2 times vary. See the processing times link in the flow chart. Just because they got the answer to your RFE does not by any means mean youre going to be approved immediately.

The RFE is a temporary delay where while reviewing your file before handing it off to be processed they discovered something was missing (the photo) they sent you the RFE to correct it. You did. Your file is now complete and will be loosely speaking 'placed back in its spot' and will be worked on when its worked on.

(if you wish to get a 'head start' you can research and prepare the forms the embassy will need in advance. If you are doing the K1)

Just because they got the answer to your RFE does not by any means mean youre going to be approved immediately.

Yes, you are right about the 129F. We received our NOA 1 almost 10 months ago. It has been more than 60 days after they had gotten what they asked for RFE. I know there is only average timeline for NOA2 but at the same time they mentioned that they will proceed our case within 60 days after getting what they need. It was written in RFE letter. SO isn't it a certain timeline?

The 60 days means when you submit your reply to the RFE - meaning whatever evidence you submitted- they typically allow 60 days to review it and 'put you back' in your place to resume processing. Just like they give you 30 or 60 days to reply to the notice, they give themselves 60 days to review your response.

Based on your follow up phone calls, they seem to have confirmed they did receive your response and have resumed processing on your file.

Im sorry you are still waiting for your NOA2. Since it has been 10 months, your NOA2 should be coming very soon. Granted you 'lost' time waiting for your RFE and then the time they took reviewing it and putting you back in line to be processed, so you have to account for that.

As I suggested before, you can pre-plan and and began gathering docs for the embassy stage if youd like.

You also have the option of contacting your reps to inquire about your status or placing inquires through the phone center if you are outside of normal processing times but I dont know if you are because like I said, you do not have a timeline.

I am in a bit in similar situation.

I mail K-1 docs on May 24,2012.

Received reply from them on May 28 saying that my case has been started.

Then till Jan 2013 nothing happened. When I call then before Jan 2013, they were just telling me that they are not processing yet May 28,2012 cases. Then I called them Jan 10 , telling them that my case is outside the normal processing times. They created referral ID.

Then I received email from Vermont Service Center telling me that my case is still under review(that was all,no requests,no details) and that within 60 days I will received NOA or decision.

So far 53 days passed and nothing happened. I dont think that for the last 7 days they will do something. This really s*x, because when you call them , they are just telling you ... "the 60 days have not passed yet... you have to wait till they pass". wait wait ... wait :(

I am in a bit in similar situation.

Yes, really seems quite the same, sorry for your situation. Hope they will approve your case within this week. But in our story they had surpassed all hypothetical redlines. It is really upsetting.
