Hello,

Danita's 12 year old son is listed on our k-1 but he is now living with his father and in a very good school in Thailand so Danita is not sure if it is best for him to come to U.S. in the first 12 months. Does anyone have experience with getting a visa for a child later from Thailand? Because of quotas, I understand that wait times can vary from country to country.

I believe it's fine to have a child follow later. Look for Rin and John on this website. They did the same thing I think. There are no quotas for stepchildren under 21.

From my own experiance I can tell her to bring the boy when she comes. My husband insisted we do this and it turned out to be a great idea. The child needs to get into a American school for many reasons including the social aspects. My daughter has done very well here; has become a well adjusted American teenager. She is happy in her school with many friends while being involved in all the school activities. As an example she arrived here with limited English skills but went on to win her school speech contest. These schools are amazing.

I also think its best for both of you to have the child with you. A friend left her kids and is still having a lot of problems in her life including her marrige. She just feels incomplete.

We brought my step daughter over about a year after my wife came to the US, she wanted to get settled in before her daughter came over. She was a K-3 visa and the embassy issued her daughter a K-4 follow to join about 11 months after her visa, we used a visa service in BKK so all I needed to do was a new affidavit of support for her but I think the process is pretty straightforward. I think the K-1 and K-2 process will be the same and you have a year from her visa to get the K-2. Once she got the visa she had 6 months to use it but is was good for 2 years while we did her AOS. It has worked out well, she was 8 when she got here and has adjusted great. Only drawback is that the AOS is more expensive if you do them seperate.

As Karee said, there is no limit for stepchildren under the age of 21. The timing will determine your process. Less than 12 months, your stepson can get a K2 visa as a follow to join. Best to do this before submitting AOS for your wife so they can file together. After a year, you would have to file an I-130 with USCIS, then go thru NVC, then the embassy. Your stepchild would receive their green card after arrival.

Rin was a K3, arrived in april 2007. We returned in September 2007 and applied for her children's visa (K4). I just contacted the embassy submitted their paperwork, and went in for a brief interview. They accommodated my request for the two week period Rin and I were to be in Bangkok.

I agree with Ning, the sooner your stepson is in the US and enrolled in school, learning English, and making friends, the better. The most important 4 years in school in the US are high school. Grades in high school determine the colleges at which you can get accepted. Giving your stepson an extra year in US schools prior to entering high school to get adjusted would far outweigh attending any school in Thailand, in my opinion.
